“That’s Crazy!!!” – More Chronicles from the VA Chapter 7

Oh, how I wish and long for, and am working for, the day when the VA is cleaned up, cleaned out, and corrected completely!  The Department of Veterans Affairs (VA) – Office of Inspector General (VA-OIG) has been busy reporting more on the failures of the VA to act.  Yet, where is Congressional action in scrutinizing the executive branch’s actions?  Honest question, repeated only for emphasis; we elected you to do two jobs, write fair and equal legislation for all citizens, and scrutinize the executive branch; when are you going to do your jobs?

Let’s begin with some softball issues repeated from previous VA-OIG comprehensive healthcare inspections (CHIPs), specifically how employees report feeling morally distressed while working at the VA.  Moral distress is a leadership failure and is widespread enough to reflect the problem is not limited to a single VAMC/VAHCS.  From Virginia to California, Maine to Florida, and Montana to Arizona, too many VA facilities are poorly led, poorly administered, and poorly executed.  The VA is actively abusing the veterans for political gain; some have asked why I consider the VA is actively abusing veterans; let me see if additional disclosure can explain the problem.

VHA Directive 1004.08.  VHA defines an institutional disclosure as “a formal process by which VA medical facility leader(s), together with clinicians and others as appropriate, inform the patient or personal representative that an adverse event has occurred during the patient’s care that resulted in, or is reasonably expected to result in, death or serious injury, and provide specific information about the patient’s rights and recourse.”

The above quote is from the regulations governing VA care.  The VA-OIG quotes this directive, which has been published and is openly available, yet repeatedly the VA-OIG finds directors.  Hospital administrators who are informed and able to repeat this directive.  Who repeatedly refuse to follow this directive or train their staff to follow this directive.  When sentinel events occur (death, permanent injury, non-permanent injury, disability, etc.), the families report having no idea what to do because the disclosures were never provided to the veteran or designated caregiver.  Is this not abuse of the patient?  Is this abuse not driven by ideologues who gain from the harm they cause others?  Should this abuse not be scrutinized until it is eliminated?  Please feel free to read some of these comprehensive healthcare inspection reports from the VA-OIG, see the resulting injuries and problems caused by the failures of government medical providers, and then tell me whether these atrocious actions need more or less scrutiny and qualify for the title abuse.

North Carolinian veterans, VISN 6 is all yours, and would you be shocked to learn that even with newer leadership, moral distress remains a persistent problem in the VA employees throughout VISN 6, which just happens to include Durham, Asheville, Fayetteville, Hampton, Richmond, Salem, and Salisbury North Carolina?  Probably this is not unfamiliar as the patient experience survey scores remain persistently below VA averages, reflecting that new leadership is akin to putting lipstick on a pig.  Interestingly, medical staff credentialing remains a significant concern in North Carolina.

Western New York veterans, especially those receiving patient services in the Buffalo VAHCS, do you agree with the VA-OIG report?  The Buffalo VAHCS includes Buffalo, Batavia, Jamestown, Dunkirk, Niagra Falls, Lockport, West Seneca, and Olean, and the comprehensive report is mystifying to me.  For example, the VA-OIG reports that “Patients generally appeared satisfied with their care.”   At the same time, “Employee survey data revealed opportunities for leaders to improve workplace satisfaction and reduce feelings of moral distress.”  This is a combination not generally found in these CHIP inspection reports.  Something is definitely off, and I would love to know what, especially since the leadership needs significant improvement in identifying and reporting sentinel events.  Do you agree with the VA-OIG findings?  Please let me know your firsthand experiences, for the double-talk in this CHIP report is above what I usually observe.

With almost identical findings and recommendations in the Syracuse NY VAMC’s comprehensive healthcare inspection, covering communities of Syracuse, Auburn, Freeville, Potsdam, Rome, Binghampton, Watertown, and Oswego, NY., I am concerned that the veterans in New York are in as bad or worse shape than Phoenix’s veteran community.  Hence, I have to ask the VA-OIG, has something changed in your measurement and analysis tools to report such disparate findings as “Employee survey data revealed opportunities for leaders to improve servant leadership and decrease employees’ feelings of moral distress.  Patients generally appeared satisfied with the care provided?”  The double-talk level is higher in these CHIPs from NY, which is rarely observed outside of Phoenix and VISN 22.  Two final thoughts on the CHIPs, staff training, continues to be a high-risk finding, and this continues to be a leadership failure for every VAMC/VAHCS/VISN in the VA; why has progress not occurred?  Training is a system, and leadership and organizational risk, system redesign, and improvement is a quality, safety, and value problem of the highest importance; why is action never taken by leadership or the congressional representatives who are expected to scrutinize the executive branch?

28 March 2022, the VA-OIG released their long-awaited annual “Comprehensive Healthcare Inspection Summary Report: Evaluation of Medical Staff Privileging in Veterans Health Administration Facilities, Fiscal Year 2020.”  I have been interested to see what, if anything, the VA had accomplished in improving their medical staff privileging.  If I were a congressional representative, knowing that medical staff continues to harm and kill veterans, I would have been anxiously awaiting to see if the repeated hits from past years had finally been rectified.  Unfortunately, the VA continues to live down to expectations (digging the hole ever deeper), suffers from failed leadership, and the veterans continue to die or suffer abuse.

What did the VA-OIG discover?  Understand, “The OIG conducted detailed inspections at 36 VHA medical facilities to ensure leaders implemented medical staff privileging processes in compliance with requirements.  The OIG subsequently issued six recommendations for improvement to the Under Secretary for Health, in conjunction with Veterans Integrated Service Network directors and facility senior leaders.  The intent is for VHA leaders to use these recommendations to help guide improvements in operations and clinical care at the facility level.  The recommendations address findings that may eventually interfere with the delivery of quality health care.”  The OIG identified deficiencies with focused and ongoing professional practice evaluation, provider exit review, and state licensing board reporting processes.  Specifically:

    • use of minimum criteria for selected specialty licensed independent practitioners’ focused professional practice evaluations
    • inclusion of service-specific criteria in ongoing professional practice evaluations
    • completion of ongoing professional practice evaluations by other providers with similar training and privileges
    • recommendation by executive committees to continue licensed independent practitioners’ privileges based on professional practice evaluation results
    • completion of provider exit review forms within seven business days of licensed independent practitioners’ departure from a medical facility
    • the signing of exit review forms by service chiefs, chiefs of staff, and medical facility directors if licensed healthcare professionals failed to meet generally accepted standards of care
    • initiation of state licensing board reporting within seven business days of supervisors’ signatures on exit review forms to indicate licensed healthcare professionals failed to meet generally accepted standards of care.

The OIG found ongoing issues from the fiscal year 2019 CHIP summary report that warranted repeat recommendations for improvement.  The OIG issued three repeat recommendations related to the following:

    • inclusion of minimum specialty criteria for focused professional practice
      evaluations
    • inclusion of service-specific criteria in ongoing professional practice evaluations
    • recommendation by executive committees of the medical staff in continuing licensed independent practitioners’ privileges based on professional practice evaluation results.

Boiling the findings of the VA-OIG down, essentially, the administrators and leadership are not weeding out poor and horrible practitioners, reporting these underperforming practitioners, and not acting in the best interests of the veterans seeking care at VAMCs and VAHCSs across the country.  I repeat, only for emphasis: Is this not abuse of the patient?  Is this abuse not driven by ideologues who gain from the harm they cause others?  Should this abuse not be scrutinized until it is eliminated?  Please feel free to read some of these comprehensive healthcare inspection reports from the VA-OIG, see the resulting injuries and problems caused by the failures of government medical providers, and then tell me whether these atrocious actions need more or less scrutiny and qualify for the title abuse.  The link to the full report is available; please feel free to make your conclusions and post your thoughts in the comments section.

On a final note for today, consider with me the problems of the Atlanta VAHCS with pallets of unopened mail containing patient health information, community care provider claims needing payment, and a plethora of other unopened mail.  Understand that when community care providers cannot obtain compensation from the VA, they go to the veterans, who then send in correspondence, which is unopened, thus causing more problems, concerns, and issues for an already abused veteran community!  Want your head to explode?  Look at the pictures the VA-OIG helpfully sent along with this VA-OIG report, and ask yourself if any other business or organization could get away with this type of abuse of the customer.

What did the VA-OIG find?  Well, prepare for your head to explode, again:

    • VA Leadership should have established a formal agreement explicitly detailing each office’s responsibilities.
    • VA HCS leaders did not include responsible managers in decision-making discussions and lacked a clear understanding of the volume of mail processing work they were accepting.
    • Atlanta VA HCS did not ensure mailroom staff was adequately prepared or trained to handle or sort the influx of mail. POM (Payment Operations Management) officials were later reluctant to help, citing the verbal agreement.

Buried in the report is this tidbit, “POM is implementing similar transitions at sites across the country; POM and medical facilities need to ensure adequate staff with sufficient training to handle the mail processing workload.  VA concurred with the OIG’s five recommendations.”  Meaning that in a VAMC/VAHCS near you, unopened mail due to verbal agreements will soon add more distress and disgust to the veteran experience.

I have documented in these articles how verbal agreements, verbal standards of work performance, and verbal processes and procedures are the problem and way of life in too many CHIPs and observed practices at the VA.  Yet, these verbal shenanigans are more apparent than in the dilemma Atlanta faces due to unopened mail.  Payment operations to community care providers are on a controlled and fixed timeline.  Failure to process these payments according to the required timeline leaves providers unpaid, which diminishes the community care provider pool of providers.  Talk to a community care provider, and they will discuss the risks of doing business with the VA and the real possibility of not being paid timely enough or being caught in sufficient red tape never to receive payment.

I know of a provider who called me three years after receiving care and was still trying to appeal and correct the paperwork to receive payment.  A provider recently contacted me who wanted to ruin my credit for failing to pay the balance due from care received, and they are charging interest.  Correcting this problem cost me 48 business hours, 20 calls, and frustrations galore.  By the way, the problem still has not been rectified, an appeal is in process, and we have to wait for the VA to make a decision; this incident was caused by the VA changing the process and the paperwork.  The provider told me they are not accepting any more veterans seeking care, the risk is too significant, the timeline to receive payment is too long, and the VA never pays what is charged.  For example, I recently received a declaration declaring payment to a community care provider.  The VA sent me to this provider, which means they knew the prices beforehand and agreed to the fees.  The declaration declared the VA was charged $2,000 and paid $120, not actual amounts, but close enough to communicate the problem.  With inflation, or without inflation, if you were paid less than 1/10th of what you billed (invoiced), would you continue to conduct business with that company or organization?  Now add the unopened mail problem to the mix.  Would you continue to conduct business with this entity?

America, the Department of Veterans Affairs is sick.  All of the other alphabet agencies in the Federal Government are sick.  We continue to elect people who actively refuse to care enough to act according to their mandated duties.  We cannot afford the government we currently have, which is part and parcel of the problem with inflation in America right now!  Debt is entered into to pay for this bloated feckbeast called government; from the city to the federal government, the bloat is too great to be sustained!  Why is the VA able to skirt responsibility, accountability, and improvement?  They can hide behind the size of their convoluted and twisted organizational shield.  Why can the Post Office and the IRS get away with deplorable, at best, customer service?  They are protected by the congress refusing to scrutinize and hold people accountable.  When your head is done exploding, please remember and act in the ballot box to hire better representatives!

“That’s Crazy!!!” – More Chronicles from the VA Chapter 4

Last week, my primary care provider informed me that the VA is no longer responsible for providing my prescriptions as an outside provider that the VA Community Services team sent me to has increased my dosage.  My primary care provider pulled a Pontius Pilot and washed her hands, and I am swinging in the wind with more bureaucracy and less service.  The best part of the news delivered this last week, the fallacious, seditious, and felonious attack on my character, the behavior problem flag, is controlled by the primary care provider.  Boy, I am sick of the bureaucracy of the VA; if only this were the worst of the bureaucratic baloney, the VA is pushing out.

From many VA-OIG reports during COVID, the following, or something close, was a regular statement:

During COVID-19, VHA’s Office of Community Care (OCC) took steps to ensure veterans continued to have expanded access to health care in the community, as required by the VA MISSION Act of 2018.  OCC issued policies to VA facilities to postpone non-urgent appointments and offer alternatives to in-person care, such as telehealth.”

The VA-OIG inspected to see how closely this statement was adhered to during the height of the COVID pandemic.  What surprises no one is how badly the VA managed community care during the pandemic.

Findings:

    • The VA-OIG found that routine community care consults were unscheduled, averaging 42 days, not meeting VHA’s timeliness goal of 30 days.
    • Community care staff faced significant challenges beyond their control that contributed to the scheduling delays, such as the lack of availability of appointments in the community.
    • Some patients were hesitant to schedule appointments during the pandemic, failed to return phone calls, or declined care once it was offered. – While some of this is definitely patient-driven, what is not discussed is the abrupt shift, the lack of trust, and the confusion about the need to pay the community providers, among other things, faced by veterans forced into community care. As a reference point, it has been 24-months, and I am still facing requests to pay several community providers due to the VA not paying the bill due to a technicality.  The VA claims the provider has to “eat the costs,” but I keep getting statements and calls from collection agencies.  Guess the direction of my credit score, the direction of my insurance costs, and how happy I am with community care providers.
    • The VA-OIG found community care providers and staff did not consistently comply with requirements to manage routine consults, and leaders lacked tools to sufficiently monitor program operations that could have identified the problems.
    • Deficiencies emerged in documenting when patients were contacted about scheduling appointments, designating patients eligible for alternative care, and ensuring staff was trained in ways that would address those weaknesses. – Not to mention that pertinent medical records still haven’t been transmitted, received, and alerted the primary care provider. I had gallbladder removal surgery; no records ever made it to the VA.  I have MRIs, CT scans, and ER notes that, even after being hand-delivered, have not been added to my VA electronic health record and presented to the primary care provider to discuss, dating back to 2010.

How’s that community service program working for you?  In any other industry, this performance would represent an abysmal failure; but community care represents a healthy opportunity for improvement at the VA.  The findings listed are a mere drop in the conclusions discussed in the report.  I have a suggestion for the VA, stop overpromising and underdelivering.  How about you under-promise and then over-deliver?

The following VA-OIG inspection report focused on the Veteran Health Administration facility’s adherence to guidelines for medication management, and the following explanation is quoted from the report:

This report describes medication management findings from healthcare inspections initiated at 36 VHA medical facilities from November 4, 2019, through September 21, 2020.  Each inspection involved interviews with facility leaders and staff and clinical and administrative processes reviews.  The results in this report are a snapshot of VHA performance at the time of the fiscal year 2020 OIG reviews.”

Before we get into the findings, let me elaborate on that statement.  The VA-OIG cherry-picked/hand-selected call it what you will, the facilities to inspect.  No criteria discuss how these facilities were selected.  More, the processes chosen for review were also cherry-picked/hand-selected.  Appearing to represent that, the VA-OIG stacked the deck to obtain success, and the VHA still failed, or rather showed weaknesses.

Generally, the VA-OIG rated the VHA facilities as “compliant.”  But “weaknesses” were identified; read that as the VHA cannot follow established guidelines, protocols, and processes, even though they wrote and established these guidelines and medication protocols.  I call this designed incompetence of a criminal nature, but I am not half as lenient and politically astute as the VA-OIG!

Findings:

    • Aberrant behavior risk assessments
    • Concurrent benzodiazepine therapy
    • Urine drug testing
    • Informed consent
    • Patient follow-up
    • Quality measure oversight.

The following, also from the medication’s adherence inspection, remains significant:

“The OIG examined the following indicators of program
oversight and evaluation:

      • Performance of pain management committee activities
      • Monitoring of quality measures
      • Following the quality improvement process”

For the weaknesses represented in the findings to be prevalent, the “Pain Management Committee activities” represent a general failure of the committee to function!  For quality processes to be a finding, monitoring quality signifies that the bureaucrats are NOT doing the jobs they were hired to perform!  A quality process fails when the humans tasked with oversight refuse to engage, and the VA-OIG findings testify to the truth of humans actively refusing to do their jobs individually and collectively!

Having read and written about the VA-OIG reports for almost ten years, I swear sentences containing the following represent a majority stake in why the VA-OIG cannot be trusted.

VA-OIG inspections… underscored the value of independent oversight of care received in these settings to help VA make continuous improvements.”

Really?  Are you sure the VA-OIG inspections provide “independent oversight” and spur “continuous improvement” at the inspected VA facilities?  I have significant doubts the inspections do anything more than highlight the problems as the VA-OIG inspectors have no teeth, and lying has zero repercussions for the humans defrauding the taxpayer!  How do I know this; the VA-OIG reports generally go on to make a claim similar to the following:

The OIG’s findings show that immediate attention is needed in several critical areas….”

Do you, the dear reader, understand better the frustration of veterans and their families?  When the Office of Inspector General (OIG) for the Department of Veterans Affairs (VA) covering the National Cemeteries, Veterans Benefits Administration (VBA), and Veterans Health Administration (VHA), can be deluded, distracted, and duped by conniving and conspiring people, what else can the veterans and their families do BUT become frustrated?  This is behavior unacceptable in every industry.  In fact, legislation overseeing non-government healthcare is strict in outlawing the conduct observed in government-provided healthcare, but somehow the VA is exempt.  Yet, the VA continues to make claims such as the following:

This is how the VA is delivering on its promise to care for the veteran who has borne the battle, his widow, and his children.”

But don’t take my word for it; the VA-OIG conducted several more Comprehensive Healthcare Inspections (CHIPs), resembling cookie-cutter inspections.  Staff training continues to be a major delinquency labeled as “High-Risk.”  Behavior Committee continues to be a central sticking point and inspection problem.  Cleanliness, tagged under “Quality, Safety, and Value,” continues to represent an area for growth and development.  Nurse-to-Nurse communications remain constant as a problem, and electronic medical records are not helping to improve on this problem.  Inter-facility transferring of patients, policy, and documentation also resemble a constant issue.  I feel like I could summarize a CHIPs report with my eyes closed; tell me, when does the “independent oversight” spur “continuous improvement?”

On the topic of “independent oversight” spurring “continuous improvement,” the VA-OIG conducted a VHA inspection of mental health activities for FY 2020.  Declaring:

This report describes mental health-related findings from healthcare inspections initiated at 36 Veterans Health Administration medical facilities from November 4, 2019, through September 21, 2020, and electronic health record review at five additional facilities.  Each inspection involved interviews with facility leaders and staff and clinical and administrative processes.”

Again, how the facilities were selected and the items reviewed appears to have stacked the deck in the VHA’s favor.  The VHA is still failing, showing weakness while generally being compliant.

Findings:

    • Completion of four follow-up visits within the required time frame
    • Appropriate follow-up of veterans with high-risk patient record flags who do not attend mental health appointments
    • Suicide prevention training
    • Completion of five monthly outreach activities.

Under these four categories, recommendations for improvement included:

    • Registered Nurse Credentialling – Source verification of licenses.
    • Staff training on Suicide Prevention
    • Care Coordination – Especially in transferring the patient, form completion, and evaluating transferred patients
    • Medication list transmission during transfers
    • Staff Training
    • Patient notification
    • Attending the Disruptive Behavior Committee

For anyone else keeping record, most of the list above is a repeat from the last several years the mental health inspection has occurred.  Color me shocked that the VA would still have issues remaining year-over-year, and if you cannot hear the sarcasm in that statement, I have some suggestions for you!

I am thoroughly sick to death of the VA failing in its mission, then bragging they are providing “Excellence in Healthcare.”  If the staff is not trained, they cannot perform their jobs, representing a leadership failure.  This is a truth for all industries, occupations, businesses, organizations, etc.  Nobody is exempt from this statement of fact, yet the VA-OIG keeps on swallowing this excuse year-over-year, and NO PROGRESS is EVER made!

America, are you aware of what the various government agencies are doing with your money, on your time, and with your consent?  If your neighbor took your checkbook and wrote checks you are legally responsible for paying, would you want better services rendered?  Elected officials (yes, I am including those at the city, county, state levels of government), why are you NOT scrutinizing the government more effectively and rigorously?  You, the elected officials, are the neighbor writing checks; why are YOU NOT doing the job we hired you to perform?

Elected officials, did you know that VA is not required to maintain records of returned bills, as a matter of policy, but those returned bills mailed to veterans are causing hardship for veterans.  I cannot recount how many times I have changed my address and my spouse’s address with the VA, on the VA-approved websites, and in-person with VA representatives, and still have had mail not delivered for months due to a wrong address in a legacy system.  Yet, the VA is not policy mandated to check returned mail, track that mail to a veteran, and check the different legacy and non-legacy systems for address veracity.

Elected officials, do you read the VA-OIG reports?  Honest question, as the following is directly from a VA-OIG report.

“[VHA primary care] providers did not consistently

        • Identify a surrogate should the patient lose decision-making capacity
        • Address previous advance directives, state-authorized portable orders, and/or life-sustaining treatment plans
        • Address the patient or surrogate’s understanding of the patient’s condition.”

The VA designed the PACT Team to improve care and deliver on the VA’s mission, yet the primary care provider has the following failures weaknesses showing.  The VA-OIG can do nothing to improve this glaring oversight, but you were elected to force change and spur “continuous improvement” in the executive branch officers and employees.  Well, where are you?  The VA-OIG substantiated that a failure in the PACT team led to a delay in a cancer diagnosis, causing increased pain, problems, and resource loss for a veteran; where are the elected officials, and the media for that matter, in raising a holy rhubarb on the PACT Team failing this veteran?

Elected officials, did you catch that statement in the VA-OIG report on the cancer diagnosis?

Facility leaders have an unwritten expectation that primary care providers conduct a thorough historical review of the patient’s electronic health record starting with the most recent annual note; however, the OIG found that not all of the patient’s providers conducted historical reviews, but instead focused on current issues and problems identified by the patient.”

Having transferred between PACT teams inside the VHA and state-to-state, I can affirm this is exactly what is transpiring in the PACT team; the second most important player, behind the patient, is the primary care provider.  When the primary care doctor fails in their job, like dominoes falling, the care of the patients rapidly cascades into a dynamic failure of healthcare in a VHA facility.  What are YOU doing to stop this madness and demand accountability?

The electronic health record has a section near the top of the record for “Problem List.”  Guess what; when providers fail to keep this section updated, current, and accurate, the healthcare of the patient borders on malpractice requiring only a slight push to arrive with a dead veteran.  The VA-OIG found providers and nursing staff failures to update the problems list accurately, keep the problems list current, and regularly discuss the problems list with the most critical member of the PACT team, the patient!  Providers failed to comply with sound science, good business practices, and act appropriately for the patient’s health; do you think this might be a slight problem in the PACT team?

I have offered the VA several suggestions for plotting a path forward.  Yet, the VA cannot and will not take advice without stern and reproachful measures taken by Congress.  Elected officials, it is time for you to act and groundswell the changes needed in every government agency, even if it means reducing the size of government!

Session Title:  Able, Not Disabled, Not Differently-Abled

Introduction:  The following are my notes delivered at a global conference for disability inclusion held 27 October 2021 regarding how to improve disability inclusion in the workplace.

Description:  Increasing abilities by removing boundaries, discussing paths forward in ability inclusion, and building upon the great work Amazon and several other companies have done in pioneering disability inclusion in the workplace.

Welcome to a discussion on abled, not disabled, not differently-abled!  I am glad you’re here!  I am Dr. Dave Salisbury; I look to complete my Ph.D. in industrial and organizational psychology by November 2022; if you would like to participate in my dissertation, don’t hesitate to contact me outside this forum for more information.  I possess an MBA in global management specializing in human resource management, a master’s in adult education design and training, and have been a business consultant since 2004.  I am a dual-service US Army/US Navy disabled veteran.

My intent today is to help break down barriers so we can be comfortable around each other.  So comfortable that we can share jokes about my disability, we can look past the twitches, the spasms, and the stutters and find common interests.  Disability inclusion is precisely this, the inclusion into a society of those with disabilities to the point that we do not see the disability, we do not recognize the handicaps, and we can then work in an atmosphere of ability.

I have several disabilities, most stemming from injuries sustained in military service; some include my voice, some include neurological issues, and others are physical and mental.  Regardless, as these injuries have increased in severity, my professional intent began to be recognized for my abilities, talents, skills, knowledge, and potential, not for my disabilities.  Yet, I am often seen only as a disabled person or worse, a “token” disabled person filling a slot that another person could be occupying.  I ran into this thinking in the Federal government, New Mexico State, Bernalillo County, and Albuquerque City government hiring practices as recently as 2019.

Earlier in my professional life as a disabled person, I was told not to be thinking of myself as disabled but as “differently-abled.”  I am not differently abled!  Differently abled draws lines and limitations; it separates people and places boxes on potential.  Worse, it allows for the continued breeding of an “us against them” mentality, which breeds hostility and counterproductive beliefs.  Thus, I refuse to be differently abled.  I do not particularly appreciate being classified as disabled either.

Please allow me to digress for a moment.  The transitive verb “dis” means to show disrespect, insult, or criticize.  As a prefix, “dis” is defined as the opposite of something, depriving someone of something, excluding someone, or expelling someone.  Thus, a disabled person is either being disrespected, insulted, criticized, deprived, excluded, expelled, or is the opposite of able.  Frankly, I believe that when we are made aware of the etymology of words, we are then more aware of why people choose to adopt or not adopt certain words and labels.  I repeat, only for emphasis, I do NOT particularly appreciate being classified as disabled, for I AM able!

Words and labels should not be the focus of our attention and efforts.  I prefer handicapped to disabled based on the etymology, even though I don’t particularly appreciate being considered handicapped.  A handicap can refer to a disadvantage in task completion, physical or mental disabilities, and can intentionally place a person at a disadvantage; there’s that “dis” again rearing it’s disrespect, insults, criticism, deprivation, exclusion, and expulsion.  Please, let’s stop focusing on word games and plastic phrases; instead, let’s invest efforts in finding solutions to existing problems.

How big is the problem of word focus; in the past few weeks, there have been several email chains based solely on a person’s word choice preferences.  I would venture to presume that not a single person intended to cause insult or denigrate a community member by using or not using a specific word, phrase, title, verb, adjective, etc. in describing a person or population in the community.  Yet, people chose to take offense, and others rushed in to ameliorate the feelings of the one choosing to be offended at a word.  Bringing up a fundamental aspect of disability inclusion, individual responsibility, accountability, or self-rule.

I am able!  I take a little more time, need a couple of extra breaks, and use additional technology and equipment to complete tasks.  I possess skills, talents, experiences, and knowledge valuable to situations, teams, and companies.  I bring to the table unique perceptions, insights, and benchmarkable skills worthy of consideration.  I bring formal and informal education and experience that is invaluable and immeasurably useful as an asset to the organization.  I am all this long before we ever discuss my physical and mental concerns or disabilities.

My first priority is my personal safety and security; my first job is to look out for myself.  Monitor what I am carrying, how far I must take it, doors, elevators, paths for egression in emergencies, methods for being warned, and what I can and cannot do.  For example, as COVID-19 began, I knew I could not wear a mask and asked about those of us who could not wear a mask.  I saw the confusion on faces. I witnessed the policy shifts, the harassment, the legal segregation, and suffered legal abuse and discrimination for not wearing a mask.  I realize that eventually, my injuries will require my independence to be curtailed, and I will become more dependent.  As such, I have to monitor what I can and cannot do constantly and clearly describe this to those I work with.  The same should be true and expected of all people regardless of handicap or level of ability.  Individual responsibility for safety, security, and health does not end just because they enter a building and should be stressed as a regular aspect of workplace safety.

Amazon has performed incredible work and is one of the few companies that has done pioneering work leading to real success in disability inclusion on a global scale.  The question before us is where and how we build upon this work to improve the culture and potential of all employees, regardless of ability, in all industries and businesses, based upon the pioneering work of Amazon.  I believe the following action items can be the building blocks to successfully enhance the inclusion of people of all abilities, talents, skills, and knowledge.  I will revisit these questions when we get to the discussion portion; please consider these points.

  1. Conflict is good, beneficial, and a tool that is useful for building people, teams, and businesses. Douglas Malloch wrote a timeless poem, “Good Timber,” which is the quintessential discussion on why and how conflict is good.  Let us embrace conflict as the tool it is for improving people.  A handout is available for further consideration on these topics, and all bullets discussed, with reference materials for additional research if you desire.  Please send me an email if you would like these materials.
  2. Leadership begins with followership; followership begins with being lifelong learners, learning requires opportunities to teach, teaching is a prerequisite to learning, and learning requires the ability to lead and apply. – These are merely starting points to understanding. They are facts.
        • Do we encourage delegation and learning through experience?
        • Do we embrace failure as a tool for lifelong learning?
        • Leadership is not a title; leadership is first an attitude, then an action, and finally a method of learning and teaching. How do we apply these truths in daily activities?
        • Leadership as an attitude is witnessed in good followership, even when our followers practice loyal opposition; are we embracing the loyal opposition? Do we know how to recognize the loyal opposition?
  3. Flexibility and agility require open minds. Open minds need varieties in opinions, politics, beliefs, religions, and so much more.  Open minds begin with lifelong learning!  Lifelong learning requires self-reflection. – Again, we find fundamental truths, simply explained and expounded.  How are we embracing these truths in daily practice?  What actions are we supporting in the workplace to showcase support to and openness to variety in thinking and commitment to lifelong learning?
        • What book did you just read?
        • Did you share that book, recommending it to whom?
        • Were you excited about the book?
        • When was the last time you self-reflected?
  4. Do you believe?
  5. How will you act tomorrow?

Are there activities I cannot engage in?  Yes.  To my disappointment and chagrin, there are many activities I can no longer engage in.  Stairs are a tremendous activity I have to avoid; yes, this includes sidewalk curbs.  Standing and sitting for long periods have to be monitored and curtailed.  Walking is another activity I have to be conscious of and monitor closely.  I regularly mistake how long I have sat or walked and wind up in trouble breathing, or my legs give out from exhaustion.  But, I should not have to get into some vast dramatic affair just because my abilities are curtailed physically or mentally.  COVID-19 hit, I cannot wear a mask due to breathing issues; the mask mandates have been so embarrassing and challenging while also being segregationist, separatist, and legally expensive.  Why are disabled people still challenged on their disabilities when we are already disrespected, insulted, criticized, deprived, excluded, and expelled for merely being less physically and mentally able?

Ask yourself this question, “When I see a maskless person, do I condemn them first or think maybe they have a reason?”  That single decision is the key to the choice between building people and building disability thinking!  I do not need your answer voiced; please consider your response now and think about when you will witness a maskless person the next time.

Has anyone taken a look at the processes for obtaining work accommodations?  A work adjustment for a disability?  A mask exemption?  With all the differences in abilities, one would think the process would be straightforward to understand.  Yet, the opposite is often the truth because we refuse to embrace that we are all able and are programmed to first separate into able and dis-(disrespected, insulted, criticized, deprived, excluded, expelled)- abled.

The last two questions are not included for any reason other than to spark a conversation inside you.  Do you believe in a difference existing between disabled people and non-disabled people?  What will you do differently today and tomorrow to reflect your belief structure?

I learned a long time ago everyone has a disability, a blind spot, or an issue they keep hidden from the world.  Sometimes it is a missing eye, an arm, a leg, an embarrassing laugh, depression, anxiety, trauma, childhood abuse, adult abuse, the list is endless.  Yet, some of those “blind spots” are more severe and become listed as “disabilities.”  The government stepped in to classify people, and draw lines of segregation and separation, which did a lot of harm to people of all abilities.  I met a man recently who lost several fingers and partially lost several other fingers.  His lost and partial fingers never came up in conversation.  His abilities as a typist were terrific, and his talents on several musical instruments were extraordinary, but his missing and partial fingers were non-topics!  As a point of fact, I did not notice the fingers until I shook his hand in congratulations for his accomplishments.

Drawing lines, classifications, separations, and segregation, it never works.  Until we can look past, work past, and choose to live past the disability, we will never be equally able, and everyone suffers.  What keeps disabled people from being able; our choices.  What keeps able people from working together; our choices.  See the connection; how we choose is the single greatest determining factor in moving forward as an individual, a team, a group, and a company.  We choose to either be abled or disabled.  We choose to allow our comfort zone to define us or not to define us.  We choose to work together first or separate each other first.

Often a person lacking an ability due to misfortune of some kind will develop and magnify other abilities, an often-overlooked advantage to their value because seeing past their loss has become a lost art of possibility and consideration.  In other words, our humanity needs restoration.  Those who do not have a fulness of ability know the realities of unreasonable and unfair judgment rather than the realities of potential and are thus prevented from entering the world of abilities and possibilities by the much too often impenetrable establishment of discrimination.  We can lift people from where we are and change the paradigm of ability and advancement to a higher level of accomplishment and respect.  We can do this!  Do you believe?

How will we act tomorrow?  A similar question was posed by Brian “The Brain” Johnson in the movie “The Breakfast Club,” and new attitudes, new thinking, and new potential were born.  Are we willing to see past the outside wrapping, shun society’s labels, and choose a different path forward through action, learning, leadership, and healthy conflict?

The Proper and Improper Role of Government – Part 2

QuestionThe following is the second part of the series on the proper and improper role of government. First, imperative to the discussion is a quick recap on the purpose of a government, and then we will discuss the actual role of government.  Second, the following cannot be stressed enough, America was founded upon a Judeo-Christian understanding and philosophy.  Other representative governments have removed the influence of religion globally, but America, thankfully, continues to keep it around.  Third, nothing herein is to be misconstrued as supporting any single religion, including atheism and agnostics.  My religious beliefs are not your business, just as your religious beliefs are not my business; we are not here to debate theology, philosophy, or anything but the government’s proper and improper role.

What is the purpose of government?

The second sentence of The Declaration of Independence is long but powerful:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.–That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, –That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.”

The purpose of government is to “secure these rights… deriving their just powers from the consent of the governed.”  The rights the government is to secure are “Life, Liberty, and the pursuit of happiness.”  When talking about securing, we are not inferring that those rights come from the government, are tools of government, or can be dispersed by the government.  When discussing securing, we are talking about the government protecting against threats to, harm from, or the need to make safe from those who would do the collective body of citizens harm.  The government securing rights does not mean affixing those rights to an individual, as the individual already owns these rights.  The government’s purpose is to protect the body of citizens by making the body of citizens safe.quote-mans-inhumanity

The etymology of secure is vital to understanding the purpose and proper role of government. “Mid 16th century (in a sense ‘feeling no apprehension’): from Latin Securus, from Ee- ‘without’ + Cura ‘care.’”  Hence, without care for an individual, the government secures, protects, and defends the individual’s inalienable rights.  Not deciding what is good for the masses, not selecting winners and losers based upon the whims and wishes of a bureaucrat, but considering the entire mass of citizens without preference and defending their inalienable rights is the purpose of government.

What is the proper role of government?

Government LargessFrom many Judaic and Christian sources, one can find various systems of government in place throughout history.  From despots of the most vile to the judges of Israel, which brought liberty and freedom instead of kings, one can find just about any form of government represented in historical texts of ancient date.  More specifically, one can find the proper role of government, which is stated most simply in the Doctrine and Covenants (D&C) of The Church of JESUS CHRIST of Latter-Day Saints, specifically Section 134:2.

We believe that no government can exist in peace, except such laws are held inviolate as will secure to each individual the free exercise of conscience, the right and control of property, and the protection of life.”

Is the proper role of government clearer? For example, suppose the government is only focused upon securing the free exercise of conscience, the right and control of [private] property, and the protection of life. In that case, that government is fulfilling its proper role.  Did you notice what is missing from the strict interpretation of the proper role of government?  Social services, arbitration, buying support through forced taxation, and much more.  Except, America was established as a Constitutional Republic with democratically elected representatives.  Thus, does America’s government have a different interpretation of the proper role of government?

Ziggy - IRS AuditThe founding fathers, and several of the first presidents in America, were considered statesmen. However, statesmen are not merely politicians, and politicians are never statesmen!  A statesman is a person who is well versed in the principles or art of government, actively engaged in conducting the business of government or in shaping its policies.  The statesmen are respected for their skill, diplomacy, power to communicate ideas, and being principled.  Thus, the statesmen are morally upright and can be trusted to understand why they are morally principled and why the law should be morally centered.  It cannot be stressed enough. The true statesmen values principles over popularity and works to create popularity for political principles in government operations that are morally sound and bring the most freedom to the most people.

Consider the following from Albert E. Bowen:

Right and wrong as moral principles do not change.  They are applicable and reliable determinants whether the situations with which we deal are simple or complex.  There is always a right and wrong to every question which requires a solution.”

The Duty of AmericansNow, returning to the proper role of government, any form of government instituted by man, we find the following as guidance in measuring said governmental role.  From D&C 134;1-2, 5:

1 We believe that governments were instituted of God for the benefit of man; and that he holds men accountable for their acts in relation to them, both in making laws and administering them, for the good and safety of society.

2 We believe that no government can exist in peace, except such laws are framed and held inviolate as will secure to each individual the free exercise of conscience, the right and control of property, and the protection of life.

5 We believe that all men are bound to sustain and uphold the respective governments in which they reside, while protected in their inherent and inalienable rights by the laws of such governments; and that sedition and rebellion are unbecoming every citizen thus protected, and should be punished accordingly; and that all governments have a right to enact such laws as in their own judgments are best calculated to secure the public interest; at the same time, however, holding sacred the freedom of conscience.”

From the US Constitution’s Preamble, a person will find why the government was instituted.  “… in order to form a more perfect Union (government), establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the Blessings of Liberty to ourselves and our Posterity.”  Between the Articles of Confederation, the Declaration of Independence, the US Constitution, and the offered verses, we find similar language discussing the purpose and role of government.

Thus, the proper role of government remains simple and easy to understand.  The proper role of government is to secure man’s inalienable rights, protect private property, and ensure each citizen may pursue their path of happiness.  A citizen’s path of happiness cannot infringe upon another citizen’s pursuit of happiness, steal their property, damage their property, or destroy public property.  Hence, the government must balance the inalienable rights of a person to commit crimes against the acceptable restriction to hold people accountable to socially acceptable laws while never infringing upon an individual’s conscience.  Therein lay the seeds of the improper role of government.Apathy

What is the improper role of government?

Ziggy - NSAThe improper role of government begins with refusing to accept that government power is limited to only those powers the citizens grant the government.  Thankfully, there is a simple test for understanding what powers the government has or does not have.  The test: Can you order your neighbor to pay for welfare for another person?  If not, the government does not have this right or power.  Can your neighbor call you to pay subsidies to them for keeping their lawn and home maintained?  If not, the government does not have the right to spend taxpayer money to subsidize another person’s housing.  This simple test relates the power of government, the government’s improper role, and reasonable government restrictions.

The line between the proper and improper role of government is thin but very distinguishable using the simple test described above.  Claude-Frédéric Bastiat was a French economist, writer, and prominent member of the French Liberal School. A member of the French National Assembly, Bastiat developed the economic concept of opportunity cost and introduced the parable of the broken window.  We present Bastiat as providing the logic behind the simple test.  “Nothing can enter the public treasury for the benefit of one citizen or one class unless other citizens and other classes have been forced to send it in.”  Hence, the simple test regarding a neighbor forcing you or forcing your neighbor is justified as the test for the proper or improper role of government.Patriotism

Forced taxation is a form of legal plunder, and since payment is the test for which powers are proper or improper for government, we must return to Bastiat for a delineation of legal plunder.

When a portion of wealth is transferred from the person who owns it – without his consent and without [just] compensation, whether by force or by fraud – to anyone who does not own it, then I say that property was violated; that an act of plunder is committed. … How is legal plunder to be identified?  Quite simply.  See if the law takes from some persons what belongs to them and gives it to other persons to whom it does not belong.  See if the law benefits one citizen at the expense of another by doing what the citizen himself cannot do without committing a crime.”

Government Largess 3Legal plunder is theft through the misuse of the power of government.  Consider the following example, your paycheck.  On that paycheck, the Federal and State governments demand money from you, not earned but forced through jurisprudence and legislative fiat, and those funds are given to another person.  As a private citizen, if I took your wallet and removed money from it, I would be guilty of theft and liable to the penalties of criminal and civil law, even if I did not keep your cash but donated it to a charitable organization.  Remember, the simple test that details the difference between the proper and improper role of government.

One additional piece of knowledge where the improper role of government is described and dictates that government cannot create wealth.  No government, at any time throughout history, has produced wealth.  The government takes from the citizens to survive, and the proper role of government would see every cent of forced taxation as a precious resource, needing to be accounted to the citizens forced to pay.  People create wealth, and if you desire a full explanation of how money is created, please see the following link.

The government cannot exist without the consent of the governed.  Your inalienable rights should be the only concern of any government form, type, or methodology.  Yet, what do we find; legal plunder to buy other citizens’ support.  We find legalized plunder without transparency, without accountability, and without regard for those struggling to pay the forced taxation (legalized plunder).  We find Trillions in missing money in every government, where the representatives are not concerned, or even aware, of the money lost.  We see government spending above and beyond its intake, creating debt penalties for many future generations to pay for the benefits of the current generation, all because the government refuses to live on a budget.  We find bureaucrats treating citizens as property and abusing that property worse than any corporate polluter of the 1970s.

Knowledge Check!Look carefully, dear citizen; government only exists by the will of the governed.  Do you think it is time for a change in government?  Do you feel your government is fulfilling its purpose and proper role or is your government abusing its rights and powers as granted through the consent of the governed?  You must answer these questions and then decide where you stand.

NO MORE BS: Safety and Liberty – The Connection

DetectiveIn watching the United States Chemical Safety Board (USCSB/CSB) videos on YouTube, an epiphany occurred.  In a safety-first culture, the employees are all responsible for near-misses.  The employees are expected to have the ability to act in a manner conducive to and appropriate for the safe operations of their roles.  Next, each employee has the power to halt operations if a safety problem is detected or if a better solution presents itself to avoid near-misses and future incidents.  In the protection of the US Republic, every citizen has these same two powers for the continuation of liberty and freedom inside the borders of the United States of America.

Your political party is your choice.  I will never deny an individual to act as they believe in a free society.  Consider though the responsibility each citizen is under to protect this Republic by intentionally acting to avoid electing people who refuse liberty to others, deny freedom, or produce captivity for future generations through their actions.  Transcending the ambiguous division between political flavors, we remain citizens charged with protecting the Republic from harm and crimes committed by elected representatives.

Wasting TimeFor example, President Clinton had an extra-marital affair with Monica Lewinsky, this is a known fact, and this relationship has ruined Monica’s life and defined President Clinton’s presidency.  The affair damaged America’s core fabric, showing to the world the callousness of Hillary Clinton in the abuse of women who have come forward to accuse her husband of impropriety, and crimes against this country were committed, and justice was never delivered due to political gamesmanship.  Because politicians put politics before protecting this Republic, America has suffered tremendously, and other sex crimes and problems have further deteriorated America’s morals and culture.

Anthony Weiner is a sordid tale with direct connections to the Clinton Machine, more justice not served for the victims or the Republic, and the result has been nothing short of criminal.  Sexual impropriety by elected officials is the epitome of, and exemplification of, the definition of sexual harassment; but, too often, the politicians skate on responsibility, accountability, and even receive honors and glory; for more examples, see the Kennedy Family!

Detective 4Building a safety culture takes work, requires full engagement of every person, regardless of skin color, race, sex, handicap, etc., all must pull together to reduce safety incidents so that everyone can return to hearth and home at the end of the shift, with all appendages intact.  Yet, for some reason, the same philosophy is not applied to the Republic, which protects us.  The American Republic stands for law, truth, and moral accountability.  The Republic begs us to remember, honor, and unite under a single banner, the US Constitution.

While living in Seattle, I had a friend whose foot was crushed from the ankle into his safety toe by a forklift because the forklift operator ignored his ground guide’s commands.  Brutal incident caused tremendous pain and injury to the ground guide, my friend, and the operator lost his job for failure to comply.  Harsh penalties were issued all around.  The company lost, the labor union lost, my friend lost, the forklift operator lost, my friend’s family lost; but, when justice was done being served, mercy was extended as appropriate, compassion was felt, and the people involved possessed an opportunity to make changes and begin anew.  To recommit to safety, recommit to a new and better lifestyle and work style, and growth became possible.  Had justice not been as harsh as it was, healing could never have been possible, and frustration would have been the watchword.  Trust would be forever harmed, creating space for doubt, envy, malice, and other powerful negative emotions to thrive and endure.

PatriotismConsider Harvey Weinstein’s crimes, compare those to any politician caught in the same act, doing the same crime, for the same purposes, and ask yourself were they treated similarly under the law?  The answer you arrive at will dictate the culture you prefer.  Myself, I see the politicians being not held to a higher standard but a lesser standard and consider the US Constitution in trouble because of a “One rule for thee, but different for me” mentality.  Liberty is always jeopardized when one rule for all is not upheld.  Consider Rome, the Army had one rule, slaves a different law, politicians a separate rule, the Caesars had an entirely different rule, and their Republic failed because the “Rule of Law” was destroyed!

Just as a safety culture cannot be “for safety” and at the same time “not care about safety,” the US Constitution cannot be upheld and destroyed simultaneously.  Those for upholding the US Constitution, and the Republic of America, will act to exert justice upon those committing crimes and work for a “Rule of Law” just society. They know that under the “Rule of Law,” all are better off, regardless of political belief.  Those who would uphold a dual law system do so for personal power, political gain, and the ability to be enforcers of impropriety, also referred to as terrorists, tyrants, and troublemakers.

Politics is too often referred to as a “game.”  That axiom has a shelf-life and has passed the expiration date.  Politics should never be a “game,” for in degrading political leadership to game pieces, the people’s voice becomes lost, the tyrants, terrorists, and troublemakers gain power, and the US Constitution gets shredded in the process.  Worse, a real hazard is brought to the shores of this Republic.

The Duty of AmericansWe can do better!  We can be better!  We need to be better to save this Republic!  Thus, I implore the following:

        1. Cease allowing yourself to be separated over petty and insignificant divisions. Skin, race, sexual choices that do not infringe upon others’ rights and liberties, handicap, etc., do not matter.  In a “Liberty First Culture,” we accept all, and we expect all to shoulder the same burdens to the best of their abilities.
        2. “Liberty First Culture” requires an all-in mentality. Everyone is being asked to vote smarter, holding all political representatives to a higher moral, ethical, and legal standard as they represent us, not the lobbyists, not the tyrants, not the terrorists, and certainly not the troublemakers.
        3. A “Liberty First Culture” requires action! See something that threatens the liberty of all, say something, repeat as often as required to get attention, and then act accordingly.
        4. “Liberty First Culture” demands action in accordance with the law to change the law. We do not give up our liberties just because some hooligan has decided to step over the line to become a terrorist or troublemaker!  We, the lovers of liberty and freedom, know the law, follow the law, and demand redress for wrongs through the law.
        5. A “Liberty First Culture” insists upon unity first, understanding that more can always be accomplished through unified action than through singular action. Refuse the titles thrust upon people to divide and cause friction.  Unify under the banner of the US Constitution, and there is room for all here.
