Flashes – The Power of, Reliability of, and Majesty in, the Law

Exclamation MarkFrank Crane begins our discussion with an absolute flash of brilliance from the Eternal Semaphore:

I am law.  I am Nature’s way.  By me comes order, unity.  In my hand, I hold three gifts: health, happiness, success.  I am more clever than the cleverest.  I am as old as God.  I am the secret of goodness; I am the horror of sin.  I am the eternal path, and besides me, there is none else.  Without me, men wander in the labyrinth of death.”

Do we understand what Frank Crane is trying to communicate?  Nature is ruled by law, God executes actions according to law, and justice and mercy can be served without compromising either.  Law is eternal, and nobody can escape the power and majesty of the law.  Consider another truth when understanding the majesty of law:

Give a man a chance, and you will often find him equal to the occasion.” – The Majesty of the Law (Short movie 1910).

What is the potential of a man; nobody but God knows for sure, but through obedience to the law, that man can become more than he ever thought possible.  I am listening to M*A*S*H 4077, episode 18, from season 9.  This is the episode where two buddies come in wounded, they enlisted together, they got injured, and the buddy discovers he has leukemia.  In the same episode, Father Mulcahey is expecting a visit from a Cardinal.  Two men were given a chance, faced with difficulty, who both rose to the magnitude of their stations.  What is Nature’s way; law.  R. W. Alger is quoted:

Laws are silent assessors of God.”

Father Mulcahy 2When the law is described, Leo J. Muir provides five words that are inseparably connected to describing what law is:

Eternal; Immortal; Immutable; Irrevocable; Inexorable!”

Looking back to Rome, how was Rome able to achieve greatness; they wrote their laws down and posted them above everyone’s head to symbolize that no one is above the law.  Writing down laws was nothing new, but holding everyone accountable to the law equally was unique in human history.  On this single principle, Rome rose in glory and failed ignominiously; everyone was accountable to the law equally.  Senator, pauper, soldier, general, no one could escape the equality under the law.  How did Rome lose their empire; Ceasar held themselves above the law.  At the second that law was to be applied unequally to the various classes of citizens in Rome, the fall of Rome was set in stone.

Flash forward a couple of thousand years, what do we find; the law is no longer the supreme entity governing civilized behavior.  For the cost of a lawyer, all laws become rubberized, twistable, and not applicable to those with enough money.  More than that, the tools of law, police officers, are not treated to the same laws they are enforcing, and the Monday morning quarterbacks strip them of their initiative, ability, and dignity.Gavel

The USA Today calls this Monday Morning Quarterbacking “transparency.”  As a point of fact, USA Today credits their actions to George Floyd’s death.  The officers involved in the George Floyd debacle followed standard and acceptable policing procedures.  George Floyd died from the drug combination in his system and his own stupidity.  Yet, the officers have been harassed into jail, their lives destroyed, their families ruined, all because the George Floyd inanity “looked bad” to the same media who hold themselves above the law.  The same laws that magically did not apply to Michael Jackson, politicians like Hillary Clinton, or even the Bidens and Romneys.  The media harps and complains when the rules are applied equally to them, and then harps and complain when the law equally applies to causes or people the media protects.  What destroyed Rome was the failure to equally apply the law to all citizens regardless of job, title, and friendliness with reporters.  H. W. Beecher sums the problem nicely:

Expedients are for the hour, principles for the ages.”

Laplace also pitches some additional power for consideration:

Truth and Justice are the immutable laws of social order.”

What is most often missing in modern society, any country globally; truth and justice are the laws of good social order.  Calling upon Frank Crane again, we find more consideration upholding the majesty of law:

Truth is the logic of the universe.  It is the reasoning of destiny; it is the mind of God.  And nothing that man can devise or discover can take its place.”The only constraints that you have on your income and advancement potential are those you place ...

What are the constraints upon a mans potential; look to the laws that man will obey.  Going back to Rome, Julius Caesar was but one of the more notable of Rome’s emperors; what moral laws did he obey; not many.  What social laws was he willing to follow; few to none.  Is it any wonder he was stabbed?  Modern society has the term “Arkancide,” it was invented to describe all the mysterious deaths, accidents, and happenstances that occur to people close to the Clinton political machine.  True, nothing has ever been proven, and neither President Clinton nor Hillary Clinton has ever faced justice, and I am not casting aspersions.  Merely noting there are a lot of incidents that need full and complete explanations, and transparency and accountability appear to be dodged by the Clintons at every turn.

Not that these two are the only politicians needing to face a judge and jury to explain and expound the whys and wherefores, merely noting they are definitely in the top ten of those needing to come clean about their actions while supposedly being “public servants.”  Hence the point of laws and the power in obeying the law.  When those who need to explain and expound come clean before the law, this concludes the speculation and truth and justice are meted to those needing it.

Image result for grace and truth came through jesus christ | Law quotes, Lovely quote, WordsThink of the great questions in modern society where truth and justice would solidly end speculation.  JFK’s murder, Epstein’s “suicide,” TWA Flight 800, Michael Jackson, OJ Simpson, etc.  Yet, for all the world, the truth remains missing, and questions rightly remain.  What is the power of law; the ability to publish the truth.  Consider the wise words of Rousseau:

Truth is the most precious of all blessings; it is the eye of reason.”

Radcliffe detailed the same semaphore a little differently:

There is no progress in fundamental truth.  We may grow in [the] knowledge of its meaning, and in the modes of its application, but its great principles will forever be the same.”

Both authors are semaphoring the same message and provide clarity of reason to denounce the falsehood that the US Constitution is a “living breathing document.”  This constitutional republic’s foundational principles of the American experiment are not living or breathing but are alive only through our continuing growth of knowledge in how we apply the principles.  Only those who would destroy the law talk of the principles as “living and breathing,” easily changed,” or “plasticized” into any shape to justify the application of law to let the guilty free and punish the innocent.Law Cartoon # 6402 - ANDERTOONS

Cast your mind upon the first amendment to the US Constitution, also the first of the rights discussed in the US Bill of Rights:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

Why is this the first right in the US Bill of Rights; without this right being acknowledged by the government, the executors of government would have zero restraint before forcing people to believe what they choose them to believe.  Communism in China requires the CCP member to carry their “little red book” close to their hearts.  Mimicking and parroting the twisted ideals of Mao, who learned them from Marx.  Equally as important is the final phrase, the “right of the people to PEACEABLY assemble and petition the government for a redress of grievances [emphasis mine].”  Tell me, how often have riots been “peaceful petitions for grievances to be redressed” in any of the recent years?  I repeat only for emphasis, when you block traffic, start fires, yell, scream, destroy property, etc., you are no longer “peaceably assembled” you are a terrorist group, and the total weight of the law should come down upon; you!Ravi Zacharias Quote: "Justice is the handmaiden of truth, and when truth dies, justice is ...

Consider all the “criminal justice reform,” “bail reform,” and other legislated and judicial chicanery foisted upon the American citizenry.  Surely Colton and Joseph Parker are semaphoring an urgent message:

Truth, like light, travels only in straight lines.”

Falsehood is in a hurry; it may be at any moment detected and punished.  Truth is calm, serene; its judgments on high; its king cometh out of the chambers of eternity.”

Leo J. Muir asks a question worthy of deep consideration, “Why this rigorous inflexibility of law?”  The answer should be apparent, especially when considering Rome and comparing America’s growth and current deterioration, “The immutability of law is the assurance of progress and the guaranty of justice upon the Earth.”  The US Constitution cannot be an easily plasticized document and still be a foundational bedrock of this constitutional republic.  A stone cannot be like silly putty, a non-Newtonian fluid.  Solid one moment, flexible another, shatterable, and resilient.  Laws cannot be a law and be shapeable and moldable to a situation, for then it is no longer a law, but a good suggestion applicable only to specific situations and people.  Is the point clear?truth : alcoholism

William Ernest Henley, in his immortal poem, “Invictus,” declares this immutable truth poignantly in the final stanza:

It matters not how strait the gate,
How charged with punishment the scroll,
I am the master of my fate,
I am the captain of my soul.”

The entire poem Invictus is a declaration of the majesty of law, the power of law, and the reliability of law.  Obedience of law does produce fruit or consequences for choices made, and in that choice and consequence cycle comes the justice and mercy of the law.  Once, I was asked, when I step before the bar of God, for a final judgment, do I want a lawyer or an advocate?  I do not want a lawyer, for a lawyer only plays with the law.  I want an advocate who knows the law, is aware of my good and ill choices, and can plead my case as if my fate was worth the universe’s weight.  How would you answer, and why?  Do you understand the role of law better?  What will you do right now to honor the law, even if in honoring the law you must loyally oppose those who are twisting the law for personal gain?

Knowledge Check!Let me be perfectly clear; I abhor the suffering the Ukrainian people are experiencing in the strongest language.  I denounce the actions of Russia in creating violence.  But, Zelensky is using the excuse of a Russian invasion to destroy the laws of Ukraine and create a dictatorship.  These actions are as reprehensible to me as the invasion of Ukraine!  Yet, if the American citizenry does not awake and arise, using the laws currently written, we too will see ourselves in a similar position.  Where the laws of America are twisted out of shape and then used as a cudgel to beat the American spirit out of her people, and destroy the last bastion of freedom on Earth.  The saving grace for America is her laws, and her citizenry needs to demand that all are equal under the law, for the innocent to escape and the guilty to be punished.

Let us now understand the role of law and thank “Whatever gods may be” for the immutable power of law!

Year End (2021) – An After Action Report

Bobblehead DollBetween Christmas and New Year 2019, I accepted an offer to write more frequently for a group that, at the time, was calling itself “No More BS.”  What an amazing opportunity the challenge to write more regularly became, and how much I have come to enjoy writing.  Like all things in life, the challenge came with a cost; I had exhausted myself mentally, I was spent by October.  Physically my body could not answer the call of my mind, and my mind was screaming at me to stop.  Let’s talk about drivers and BS, for the importance to American society success is found in ending the BS.

Little Joey Biden and his Afghanistan Debacle are still unfolding, and I fully admit this turn of events from August 2021 has left me numb.  When America left Hanoi (April 1975) and Vietnam fell, many Americans, especially veterans, felt defeated in ways hard to describe.  Who knew that in such a short space of time (less than 50 years), America would repeat Hanoi (August 2021) by a couple of magnitudes?  Some very cynical veterans I know suspected the politicization of Afghanistan would lead to a repeat of history; but, I can honestly say I never expected Biden to act in such a disastrous and self-defeating manner.

Leaving Americans, allies, and stakeholders on the ground, holding the bag of responsibility, remains the quintessential yellow-spine craven move of the new century.  One of the greatest insults from my time in the US Military was the corporatization of the military officer corps.  Disconnecting responsibility and accountability, honoring weak-kneed drivel to the detriment of the professional NCOs and the soldiers, sailors, airmen, and marines has been utterly unacceptable.  Why; because every corporatized military in history has failed!  Now, America has Afghanistan and Vietnam, and the government leaders refuse to acknowledge they are the problem, and the sitting president rewards pubescent behavior.  Sickening!Angry Grizzly Bear

The military, to be effective, must be out of sync with the society they protect.  A sacrifice principle is required from those who love country more than themselves and voluntarily wear their country’s uniform.  Yet, the politics and political leaders refuse to allow the military to act at home and abroad, so we repeat history.  May I ask, how many more Vietnam’s and Afghanistan’s does America need to relive before accepting that personal sacrifice is quintessential to a strong military?  Mr. President, Little Joey, when does the BS end, and the motivation to lead return from bureaucratic hands to professional officers and NCOs?  For I warn you, what you have right now is a mob, and you desperately need a military!

But, Afghanistan, in all its depravity, is not the only outrage from this year where BS needs to end.  Consider something with me, the power of jury trials.  High-profile trials have been occurring and continue through this holiday season and end-of-year celebrations.  How incredibly grateful I am for the rule of Constitutional Law that provides for a jury by peers.  More often than not, juries get the law right and hand down fair verdicts.  Yet, the Corporate Media refuses to accept that jury trials are the best method for handling problems in a constitutional society.  I have seen the media meltdowns repeatedly when juries hand down verdicts the media have tried and failed to influence.

Now ask yourself, dear reader, why does the media try cases before all the facts have been presented?  Power, the answer remains ever simple, the media have become what they consider as THE single greatest power in American society.  The self-delusion is a steaming hot pile of BS dished up for public consumption 24/7/365, and the media refuses to eat the BS they are serving.  Considering themselves better than common citizens, above the law, the media companies have decided they can arbitrate, decide, and deserve to be listened to and obeyed.  Well, jury trials work, and it is time more journalists are introduced to the concept through defending themselves in a court of law.

QuestionWorse than the corporatization of the US Military has been the continual erosion of the rule of law.  The Uniform Code of Military Justice is regularly abused for the benefit of the powerful and the destruction of the weak.  When the law is cheapened, joked about, and castigated, the trust in civil society is broken, and the military is but a smaller example of what is occurring in American society as a whole.  When warriors are not judged by their deeds, but upon their political connections, the society hiring warriors, training warriors, and sending them into harm’s way will quickly find the warriors are gone.  Their replacements are not worth the honor and trust.  Leading to society being taken over and destroyed.

Feel free to disagree, but Rome remains the quintessential example in history of what happens when a republic fails to accept social consequences, infects its society from within, and then picks fights with neighbors.  Rome had the greatest military in recorded history, and it fell ingloriously all because the military, a microcosm of the society as a whole, decided politics was more important than the rule of law.  Popularity became more important than law and obedience to the rule of law.  Who taught Rome to fall; who brought the Roman Legions to their knees?  Look no further than their politically elected leaders who spent their time and the people’s money in riotous living, perversions, and trying to evade responsibility for their actions.  Tell me, are we not seeing the same exact abuses in current society that is witnessed on the pages of history with Rome falling?

What is the only difference between Rome’s fall and any other government with elected political leaders?  Advanced weaponry to include nuclear weapons.  What is the only safeguard in republican and democratic societies strong enough to save those societies from repeating Rome’s example; learning history and obeying the rule of law.  Of the two, learning history is more important, which is why learning history was the second casualty in the fight to overthrow the rule of law.  The first casualty was teaching students how to read.

The abuse of children remains an utter abomination, and rightly so.  But until the political leaders can be made to accept they are facilitating abusers of children masquerading as K-12 School Districts and teachers, the abuse of children, the wasting of precious resources, and the sacrifice of innocence will continue and worsen.  In Virginia’s gubernatorial election this past November, the central theme was public education.  Virginia, as your newly elected officials come into power, are you willing to watch those elected and demand they obey the electorate’s will and change education in your commonwealth?Lemmings 1

Over the holiday, I watched heart-wrenching videos of parents who almost lost their child to suicide because the teachers groomed the child into transgenderism, all without the parent’s knowledge.  Worse, the parents were abused by the government when the teachers involved called “Child Protection Services (CPS).”  Tell me, when bureaucrats join together for the abuse of those they are duly sworn and duty-bound to protect, who is at fault; the elected leaders!  What did the elected leaders do when the parents complained; they joined forces to continue abusing the child and the parents.  The exact opposite of what they were hired to do, scrutinize the government employees and protect the electorate from abusive government operations, practices, and people.

Unfortunately, some of you think this is only happening in California, Virginia, New York, or some distant city/county/state.  No, the truth of the matter is this is occurring in your child’s school district right now.  Your children, grandchildren, cousins, and neighbors are all being abused and harmed, and the rot is at your doors.  Don’t take my word for it; investigate for yourself.  Go to local school board meetings and ask to see the curriculum your child is being exposed to, and you will find the truth, and the truth will first abhor, then anger, and then motivate you.

I hope the motivation will be sufficient to inspire action to become more informed, pay closer attention to local political races, and stop allowing incumbents a free pass to officiate in the destruction of America.  One of the frequent conversations in my home is, “What are my plans after I complete the Ph.D. degree I am chasing?”  The temptation is real to run for political office, either mayor or school board, sheriff, or judge; I want to get into this fight to defend the America I love.  Most people think the battle for America’s soul is being fought in the US Senate or House of Representatives when the reality is the fight for America’s soul is being fought and lost in local elections, and it is time to find strong candidates who are willing to run for office and fight this fight locally.

Jesus, Minion Memes Aren't Funny : terriblefacebookmemesThe biggest lesson I have learned in writing this year, a degree doesn’t represent smarts or capability; those come by working in the trenches for something more important than self.  The US Navy taught me endurance in the face of insurmountable odds and enemy shenanigans, and the US Army taught me to think and have grit and determination.  I know I am not perfect; I am not the “picture perfect politician.”  I prefer blue jeans and button-downs to suits and ties, but I know people, and I prefer real people to the fake effrontery currently holding the reigns of political power.

Writing this past year, I have faced my demons, and while I still fight those demons, I know the need to engage is real, helping others promotes healing, and teaching provides the opportunity to learn more perfectly.  I know the power of citizens motivated to protect hearth and home, and I celebrate freedom.  I would see my neighbors armed with knowledge, possessing the motivation to speak out and act according to beliefs and win the American heritage left us.  I believe in America, and I know that when Americans are left alone, they use the power of freedom to change the world; all we need is to shrink the government, and America will begin to blossom again.LinkedIn Image

Shrinking the government begins locally.  The local government protects against county and state government abuses.  The state government protects against federal violations.  The federal government protects borders and provides for the common trade of goods across state lines.  Limiting government is not a bad idea at all; in fact, it is the only good idea that can help save America.  Join me!

Operational Trust Embodied – Consent of the Governed

The Coliseum | AncientWorldWondersEmperor Titus Flavius Vespasian began work on the Coliseum of Rome in 69 AD.  Upon completion of the Coliseum, his son Emperor Titus held 100-days and nights of festival in the Coliseum.  Ostensibly to calm the masses after the civil unrest following the death of Emperor Nero, the Coliseum acted precisely as it was planned, distract the masses, while the emperor consolidated his power, undermined the Roman Senate, and set the stage for the end of the Roman Empire.  Roman laws were built, originally, upon the consent of the governed until the emperors broke the law.  The people rebelled, and before the squabbling senators could take control, the Roman government was subjugated to empirical rule.  All historical facts, reflecting the power of the consent of the governed and a lesson upon which we can plot the future if we are brave enough to take action.

What is Trust?

How to Rebuild Trust as a Leader - Optimize InternationalImperative to the following discussion is an understanding of the basics, and the basics require knowing what trust is, what trust does, and what trust is not.  Webster defined trust as an obligation and a condition of having confidence placed upon another.  Another definition for trust includes a firm belief in the integrity, ability, character, reliance, and having confidence in another person or thing.  Hence, trust is not just a belief but a reliance, signifying there have been experiences shared that have proven trust in the fires of adversity, and the person or thing has been found worthy.

Defining trustFor example, in the US Army, when I went through Basic Training, you spent three days in a classroom learning about gas masks, chemical, biological, radiological warfare (CBR), and other tools for protecting yourself in a CBR environment.  Then, you went to the “Confidence Chamber.”  The Confidence Chamber was there to teach you to have confidence in your equipment; by putting you in first in your gas mask, then removing your gas mask, and experiencing tear gas, you learned to trust your equipment and have confidence that what you were learning could save you pain, misery, and hopefully your lives.

The Confidence Chamber also had another purpose that is often missed in the rigors of Basic Training but is as real as the air a person breathes, building trust in the chain of command.  Asking people to do hard things, experience pain, puke their guts out, and all the other effects of the tear gas begins a trust cycle in the chain of command.  As a soldier, you can trust your sergeants and officers, and they can trust you.  Organizational trust begins with these basic experiences in basic training and hopefully grows as a soldier is trained.Gas Chamber 4

Trust is not easily won but can be easily lost.  Trust is not fully developed in a single transaction but can be germinated in a single transaction.  Trust flourishes in two-directional learning paths among people, sharing experiences, time, and values.  Trust is not a solution in and of itself, but it can be a magnifying power of other efforts in achieving resolution.  Trust is a tool, but not a tool that can be employed by itself.  For example, a screwdriver can be force multiplied by a wrench; trust is the same; it is the wrench that multiplies the power of other tools to accomplish work.

What is Operationalized Trust?

Strong Teams Start with Trust: 5 Ways to Build Trust - Invoicebus BlogEstablishing relationships requires the principles of organizational trust, as detailed by Du, Erkens, and Xu (2018), who found when supervisors trust their subordinates, regardless of whether supervisors have a general propensity to trust others or trust subordinates due to previous transactions and social similarity, customer service is significantly improved.  Operationalized trust is nothing but using a trust relationship to improve a shared or common goal.  For example, a business wants better customer satisfaction, so the supervisors use trust between themselves and their employees to increase service quality, promoting enhanced service satisfaction.

Trust quotes images and wallpapers hdIncredibly, the first principle to empowering operational trust is social similarity, which provides the breeding grounds for shared social interactions—knowing where someone originates and if they share values is critical to initiating, building, and maintaining trust propensity.  The second principle for empowering operational trust is extreme oversight; micro-management kills trust relationships and kills individual initiative, individual agency, and individual moral.  A corollary finding is that efficient use of existing control systems is not objectionable or harmful to trust propensity.  This is a critical finding in organizational trust, in that existing controls are acceptable.  When taken to extremes, the consent of the governed is rejected, and the controls become the problem killing the initiative.  Collocation and less stringent controls breed trust propensity that develops organizational trust, improving how people work, or to put it more simply, less strict controls, combined with people sharing similar backgrounds, opens organizational trust and breeds consent of the governed into productivity.

Consent of the Governed Rests Upon the Following Principles

As a reminder, the fundamental principles of a free society, a liberty first culture, and the consent of the governed rest upon the following, which should be returned to often and refreshed daily by the elected officials in government to feed operational trust in a free society and liberty-based government.

No free government, or the blessings of liberty, can be preserved to any people, but by a firm adherence to justice, moderation, temperance, frugality, and virtue, and by frequent recurrence to fundamental principles” [emphasis mine].

          • Justice: Decency to all as a behavior of equality and commitment to moral rightness.
          • Moderation: This is all about not going to extremes, being restrained, knowing the boundaries and staying within limits, and being reasonable and approachable.
          • Temperance: While primarily used in drinking alcohol, this also applies to any behaviors where self-restraint, moderation, and expressions or observance of temperate behaviors are required.
          • Frugality: Besides being a good steward of other people’s resources, being frugal requires being sparing, prudent, economical, thrifty, and reserved.
          • Virtue: Requires moral excellence, modesty, personal dignity, goodness, and conformity to a standard of righteousness.

Putting it all Together

ElectionThe consent of the governed is built upon the intermingled trust between people as a body electing government officers and people representing those elected as government officers.  The problems have arisen because many in public office have refused to accept the government of those who elected them and have served only themselves and the monied interests buying their time.  Thus, trust propensity in government has dropped to disastrous levels. Adding to the problem are the accumulated actions of previously elected officials who have set a pattern for personal wealth by tax and spend, supporting political cronies, and gerrymandering system to protect them from negative election results.  The trust between people of shared values has been broken by those elected, who never shared values, who refuse to live in their home districts, and whose time and the highest bidder can purchase interests.  Thus, is it any wonder that people no longer believe the lies of government are restless and agitated?

The consent of the governed is a precious commodity that has been squandered by those who should have held that precious resource as a mother holds her child—protecting, nurturing, and feeding the consent of the governed to build trust propensity against a time when a pandemic or natural disaster would occur.  Where the government would need to act in a difficult manner.  Instead, hypocrisy has been witnessed from the government leaders and the monied interests purchasing the politician’s time, and the people refuse their consent to be governed.  Where do we see the refusal of consent to be governed; how is the health of the US Dollar and other national currencies?  That is not just inflation blowing up prices, confidence in the future has been shaken, and confidence is the visual representation of the consent of the governed.Plato 2

Where else do we see the consent of the governed being refused?  Recently an Olympiad was held, the government of the US held hearings of great import on legislative matters to conflict with the Olympiad to hide scheduled legal hearings as smoke and mirrors.  When Kevin Durant and Draymond Green called the media out for failing to cover the Olympics, they missed the target; the people they should be denouncing are the politicians trying to distract further, confuse, and cause chaos.

Knowledge Check!President Obama proved one thing while in office when you choose to hold hearings is as important as the content of the hearings, the legislation, and the political gamesmanship.  Paying attention to all of the tricks and media hyperbole is all but impossible, and in the confusion, theft occurs.  But, the law of unintended consequences means that the consent of the governed takes a beating when these tactics are played, and soon polls will show a more significant drop in approval ratings.  (Remember how jock itch has a higher approval rating than Congress?)  Politicians will scramble, the media will try and explain the findings, but the result is always the same, the consent of the governed is being removed at a more rapid pace, and every politician of a representative government needs to start paying attention!

“All Power is … Derived From The People.” – The Consent of the Governed

cropped-2012-08-13-07-37-28-1.jpgIf you are browsing a second-hand bookstore and come across the book “We, The People: Great Documents of the American Nation” by Jerome B. Agel, I recommend picking the book up and adding it to your library.  I have not found a better book discussing the founding documents of this great American Republic.  It is historically accurate, provides insights, and is a treasure of wisdom and knowledge.

A phrase in the Declaration of Independence has always captured my imagination and held fast to my mental processes.  “Governments are instituted among Men, deriving their just powers from the consent of the governed.”  It has always been understood that men invented governments for the ruling of other men.  Rome was a perfect example of this principle, and in writing down the laws, the first attempt at a moral government responsible to the people was attempted.  However, it is the second part of that phrase that we are discussing, “deriving their just powers from the consent of the governed.”

Consider this principle for a moment. First, governments have just and unjust powers, and second, the powers originate with the consent of the populations agreeing to be governed by the government.  Czarist Russia is an excellent example from history where the people had enough and began looking around for a new government.  That the people were hoodwinked and communism was imposed upon them remains one of the great tragedies of the last century.  In less than 100-years, Russia went through two incredible government upheavals is mentally incredible to consider.Plato 2

Unjust powers of government are those powers governments assume where the people have not granted them consent of the governed.  When governments take enough of these powers upon themselves, the population’s revolution, anger, and frustration are the only outcomes possible.  Worse, the governments are breaking their laws and the trust of those who elected them, proving that the most dangerous person is an honest person betrayed.

Bobblehead DollAll of which is mentioned as we discuss the origin of the philosophy of the consent of the governed in American jurisprudence.  Virginia, 1776, The Virginia Declaration of Rights prefixed the Virginia Colony’s constitution and was written by a reluctant statesman and largest landowner, George Mason.  In sixteen statements on government and the rights of man, we find the consent of the governed and the need for controls on government pertinent to our day and time!

      1. “All men are by nature equally free and independent, have certain inherent rights, … namely the enjoyment of life and liberty, possessing property, and pursuing and obtaining happiness and safety.”
      2. “All power is vested in, and consequently derived from, the people; that magistrates are their trustees and servants, and at all times amenable to them.”
      3. “Government is or ought to be instituted for the common benefit, protection, and security of the people. … A majority of the community hath an indubitable, unalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”
      4. “No man, or set of men, are entitled to exclusive or separate emoluments or privileges from the community.”
      5. The state’s legislative and executive powers are separate from the judiciary, and the operatives return to being citizens after their respective terms in office, in accordance with the laws of the land. [Edited for brevity]
      6. Contains three principles of import:
          • Elections should be free and open to all.
          • Property cannot be taxed or deprived for public use without consent.
          • Those elected are bound to the same laws as the citizens.
      7. “All power suspending laws or the execution of laws by any authority without consent of the representatives of the people is injurious to their rights and ought not to be exercised.”
      8. Deals with a criminal trial, due process, speedy trials, a jury trial, and a unanimous jury.
      9. Deals with fines, bail, and cruel or unusual punishments.
      10. Deals with search and seizure requiring evidence of a crime and the need for a warrant to be based upon evidence or not to be granted.
      11. Holds sacred the rights to a jury trial, including for disputes between two people over non-criminal issues.
      12. Holds sacred the power of the press as a bulwark of liberty, and restraining the press is an action of despotic governments.
      13. Details that standing armies in peacetime should be avoided and a well-regulated militia is proper and natural for the defense of the state. Important to note, “the military should at all times be under strict subordination to, and governed by, the civil power.”
      14. Demands uniform government that applies to all people.
      15. Declares that “No free government, or the blessings of liberty, can be preserved to any people, but by a firm adherence to justice, moderation, temperance, frugality, and virtue, and by frequent recurrence to fundamental principles.”
      16. Declares that “Religion, or the duty we owe to our Creator, and the manner of discharging it, can be directed only by reason and conviction, not by force or violence, and therefore all men are equally entitled to the free exercise of religion according to the dictates of conscience, and that it is the mutual duty of all to practice Christian forbearance, love, and charity towards each other.”

In opening the discussion, one of the most egregious and despicable actions witnessed every year is the failure to follow the strictures of a peaceful society as required in the 16th statement, to practice the “mutual duty of all to practice Christian forbearance, love, and charity towards each other.”  Having been a student of religion, I have found no religious stricture, in any organized religious teaching, to living in harmony with others by practicing forbearance (tolerance, patience, and kindness), love (respect, kindness, gentleness, meekness, all unfeigned), and charity (service) to those in our society.  Atheists, this includes you; it is time to live in harmony with others and stop the lawfare.  If someone is not violently demanding you adhere to their religion and religious tenets, then leave them alone!

I Find the following extremely important to the news developed, especially over the last two weeks.  “No free government, or the blessings of liberty, can be preserved to any people, but by a firm adherence to justice, moderation, temperance, frugality, and virtue, and by frequent recurrence to fundamental principles” [emphasis mine].  Let’s break this down:

      • Justice: Decency to all as a behavior of equality and commitment to moral rightness.
      • Moderation: This is all about not going to extremes, being restrained, knowing the boundaries and staying within limits, and being reasonable and approachable.
      • Temperance: While primarily used in drinking alcohol, this also applies to any behaviors where self-restraint, moderation, and expressions or observance of temperate behaviors are required.
      • Frugality: Besides being a good steward of other people’s resources, being frugal requires being sparing, prudent, economical, thrifty, and reserved.
      • Virtue: Requires moral excellence, modesty, personal dignity, goodness, and conformity to a standard of righteousness.

Knowledge Check!These are fundamental principles of liberty and the foundation upon which government is built and sustained.  How often do you hear politicians discussing these terms, returning to these principles as terms to write laws worthy of printing for society or as standards for scrutinizing the government agencies?  What did we observe in government this week that adhered to any of these fundamental principles to America or any other government succeeding in the past week?  Does anyone argue that Gov. Cuomo’s actions in New York were virtuous?  Were the CDC Director’s edicts frugal, temperate, moderate, or just?  How about the reaction by Congress to the mandates by the CDC?  Did they perform their jobs to scrutinize the legislative branch using these principles?

Now, some will decry that this is a document solely for the Commonwealth of Virginia and does not apply to the entire United States.  Yet, I would counter that the principles and language of this document are interwoven into the Declaration of Independence, the US Constitution, the US Bill of Rights, and every other founding document and US State Constitution.  Thus, why could we not use The Virginia Declaration of Rights as a template to benchmark and measure the performance of politicians and bureaucrats?Image - Eagle & Flag

Fundamental principles do not age, expire, or possess a shelf-life.  Hence, knowledge of the fundamentals empowers action by the electorate to change, correct, and demand government adherence, for we are the owners of our representative government.  We, the electorate, need to teach these fundamental lessons to the politicians, then demand they adhere and hold accountable the bureaucrats to the fundamental principles of liberty, or we all lose this precious government of the people, by the people, and for the people, where the consent of the governed is respected.

NO MORE BS: What is History? A Prelude to the Future.

There is an axiom in history, “If you do not learn history, you are doomed to repeat it.”  Some have refused to believe this lesson, to their utter misfortune.  Others have refused to accept this sentiment and have suffered likewise.  How do I know this; history shows the willing student how history is a prelude to the future.

Ancient Greece was the center of knowledge, but their people stopped learning history, and Rome came in while Greece was napping and took over the country lock, stock, and barrel.  Then, over time, Rome stopped learning the lesson they had taught and was forced to relive their history when caught napping; others came in and ruined the Roman Empire.  Ancient Egypt was a grand empire until Rome.  More history leading to preludes of the future.

Moving forward several centuries, and we see the rise of the Muslim Empire, suffering the same fate as those behind it when they too forgot their history.  The repetition of history is both scary and clearly written in the annals of history.  When one stops learning their history, they become doomed to repeat that history, for history is ever a prelude to the future.

Now, I am not a doom and gloom type, nor do I have grand aspirations of being a prophet or prognosticator.  I am simply pointing out the truth and hoping others may join me in learning history to avoid repeating history.What historical lessons do we need to learn?

To answer this question, I beg you to indulge me for a moment.  I have to ask a few more questions to answer this most pressing question.  As a modern citizen of your country, do you understand the family’s value and importance to your society?  What are you doing to support the family as the preeminent foundational stone of a sound and growing society?  Are you willing to sacrifice worldly reputations, money, power, etc., to have a family?  The leading cause of the Roman Empire’s fall was that they stopped having nuclear families, and within a generation, they fell.  Why did the sunset on the Egyptian Empire; they stopped believing in and supporting the nuclear family, and they failed.  Before WWII, why was England, the world’s mightiest empire since Rome, failing; they lost the nuclear family and still haven’t recovered.

Why is France struggling, Italy disappearing, Germany struggling, and the US and Japan all having such incredible problems; all have forgotten the nuclear family.  As the nuclear family goes, so does the state’s power and the identity of a country’s soul.  Let that sink in a minute.  As the nuclear family goes, so does the country’s soul.  A country’s identity, liberty, law, freedom, and lifestyle rests squarely upon the shoulders of the nuclear family.

I have read reports that Italy will no longer be the traditional “Italy” in less than 10-years because the Italians are not getting married and having families.  I love my Italian family members, but I am so distraught to think that “La mia famiglia,” the quintessential Italian experience, will not be around for my posterity to enjoy, except through fading pictures and journaled memories.  What makes this worse is Japan, South Korea, the Philippines, France, Germany, the United Kingdom, and every other nation on earth have the same problems.   The nuclear family is disappearing at a frightening rate, and as the family goes, so do the historical lessons that need to be learned to avoid repeating.

An ignorant barbarian suggested, “well, just have people have more kids.”  I wanted to gently take this person by their ears, look deeply into their eyes, and ask, “Is anyone in there?”  Children are important but more important is the nuclear family experience.  Another person once suggested that the nuclear family, consisting of a mother, a father, and children living in the same home, is copyable for homosexual couples, divorced couples, and single parents, so what’s the big deal?”  In asking that question, the individual’s historical ignorance was apparent, and society’s problem leading to a repeat of history.

Living together as a family is messy, it is hard, and it requires learning how to live together.  These fundamental lessons become the experience that binds a nation to its culture, faith, and fundamental societal core.  There is no substitute, no shortcuts, and no other possible way to exist.  Yet, too often, the nuclear family is shunned, disrespected, and disregarded for the pleasures of living more easily.

No, I am not casting aspersions on those parents raising children as single parents.  I have known the great and good and the incredibly terrible in single parents and would support that person and those children however I can.  But, I hold this perception and desire because I know the value of the nuclear family, the nuclear family’s potential, and I know how a family makes a community, and a community makes a family.

I read the research on homosexual couples rearing children, and I weep for the children!  A more honest statement I cannot make.  I know the abuse and problems inherent in any family organization, but the problems are only multiplied a hundred-fold in homosexual couples rearing children.  The second most destructive power in Rome’s fall, mirrored from the Greeks, was the rise of homosexuality, which was preceded by a loss of morality, religious living, and the nuclear family.

President George Washington said in his final address to the nation about religion.

Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports.”  Continuing, Pres. Washington called religion and morality “Pillars of human happiness, and the duty of citizens to uphold.”  Concluding with, “Where is the security for property, for reputation, for life, if the sense of religious obligation [and morality in society] desert the oaths?  Reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle.”

I know the struggles in families, but those struggles pay dividends when we support the nuclear family.  I recently read of an 11-year old having children because her mom and grandmother were in prison, and great-grandma needed more welfare money to feed the other children living in the home.  In reading that report, I hoped this was a one-of-a-kind experience, but I was horrified to learn the exact opposite, and family courts are full of tragedies similar to this story.  Our communities are failing because the nuclear family has suffered some desperate body blows, and more welfare programs and government heavy-handedness are NOT the answer!  History is indeed a prelude to the future, and the loss of the nuclear family is front and center in this battle for your country’s soul, culture, legal system, and future.

Families, reach out to single parents and open your home.  You do not have to be perfect to help; just help!  Communities reach out to support the nuclear family.  Religious communities especially reach out to support single parents raise morally centered children and help build nuclear families.  If the nuclear family experience is lost, we will repeat history, and chaos is too small a word for the conflict that will fill every country on earth!

I offer no excuses for those who abuse their spouse or children!  I extend only support for the victims and would see the situation corrected.  In the same breath, I would offer hope to those struggling in these times to raise a nuclear family; you are doing a good job, even if it seems like every day is difficult.  Please stay in the fight; it is worth the struggle.  To the non-profit and religious organizations, get involved in the battle to support the nuclear family and morality in public and private.  Fight for morality and nuclear families; they need you, your community needs you, and your country needs you!  Especially to the organized religions and their leaders, find a spine!  Get into this fight, or die an unpitied sacrifice in a contemptible struggle!

Please, learn history, teach history, and work to support the family as a prelude to a better future!

NO MORE BS: The Role of the Rule of Law

GavelRome made global history when it wrote down its laws and posted these laws in a manner that told everyone that the law was the highest order in the land, and everyone is held to the same legal standard.  Writing down laws was nothing new in societies; the Jews had written and codified their laws long before Rome, but to hold everyone accountable to the same legal standard set Rome apart and blessed their land.  Why did Rome eventually fall; they stopped holding everyone responsible to one rule of law.

What is the Role of Law?

Ask a lawyer this question, and you will get a similar answer to the following:

Laws provide a framework and rules to help resolve disputes between individuals. Laws create a system where individuals can bring their disputes before an impartial fact-finder, such as a judge or jury.”

Frankly, my experience with lawyers is as productive as my relationship with the VA, hostile and not productive.  Hence, I infer that the law’s role in society is to bring order to a social environment, produce equality under the law, and punish those who decide to break the law.  Law is an expectation, a social contract, that restricts and constricts behavior to a socially acceptable level.

Thin Blue LineConsider today’s tragic events in Boulder, Colorado.  Before the blood was even clean at the scene, we have the President and selected hysterical gun-grabbing politicians making hay and demanding “gun reform.”  Except, “Gun Reform” always means stealing guns from legal owners and doing nothing about illegal gun holders.  Nothing is being urged to avoid and eliminate criminal behaviors with a firearm.  The Rule of Law’s role only applies to those who choose to live according to society’s laws and rules.  Those choosing to live outside society’s rules are terrorists and need to be treated as such!

President Lincoln is quoted thus:

Let every American, every lover of Liberty, every well wisher to his posterity, swear by the blood of the Revolution, never to violate in the least particular, the laws of the country; and never to tolerate their abuse by others. As the Patriots of seventy-six did to the support of the Declaration of Independence, so to the support of the Constitution and Laws, let every American pledge his life, his property, and his sacred honor; let every man remember that to violate the law, is to trample on the blood of his father, and to tear [down] the character of his own, and his children’s Liberty. Let reverence for the [Constitutional] laws [of America]… become the political religion of the nation.” President Lincoln is quoted thus: “Let every American, every lover of Liberty, every well wisher to his posterity, swear by the blood of the Revolution, never to violate in the least particular, the laws of the country; and never to tolerate their abuse by others. President Lincoln continued to proclaim:

When I so pressingly urge a strict observance of all the laws, let me not be understood as saying there are no bad laws, nor that grievances may not arise, for the redress of which, no legal provisions have been made, I mean to say no such thing. But I do mean to say, that, although bad laws, if they exist, should be repealed as soon as possible, still while they continue in force, for the sake of example, they should be religiously observed.” The Collected Works of Abraham Lincoln edited by Roy P. Basler, Volume I, “Address Before the Young Men’s Lyceum of Springfield, Illinois” (January 27, 1838), p. 112.

Does President Lincoln’s plea inspire you, encourage you, and provide direction for improving the government moving forward?  The role of the “Rule of Law” is to empower and motivate people, to create order in a society, and to constrict and restrict behaviors for those choosing to live outside societal norms and acceptable behaviors.  Is the role of the “Rule of Law” clear?

As President Lincoln was quoted above, the “Rule of Law” in America is:

“[The] support of the Declaration of Independence, the support of the Constitution and Laws, let every American pledge his life, his property, and his sacred honor; let every man remember that to violate the law, is to trample on the blood of his father, and to tear [down] the character of his own, and his children’s Liberty. Let reverence for the [Constitutional] laws [of America] … become the political religion of the nation.”

Are laws currently abusing America; absolutely!  Herein is the charge to action; the government has chosen to declare you are the US Government’s property (Reich, 1964).  Charles Reich’s discussion on “New Property” is unacceptable and unconstitutional in the extreme.  The lack of treating the western states in a constitutional manner is also unconstitutional.  The theft of farmer’s goods, fisherman’s wares, and ranchers’ products remain 100% unconstitutional.  Yet, the bureaucrats’ actions and the politicians continue to treat you and me as unwanted property in our own country.

ApathyLike Rome, the legislators and the President are not above the “Rule of Law.”  Even though these people continue to consider themselves above the “Rule of Law.”  Worse, no matter how many laws a country produces, if the society is immoral, the “Rule of Law” is a joke.  Consider the knife and machete attacks in the United Kingdom, outlaw guns, and people are still finding ways and means to hurt other people.  France has stringent laws, yet people rent vehicles and mow their neighbors down in case lots.  Japan, very orderly society; how do criminals make the news there; they use chemicals to poison their neighbors on a subway.  Laws do not dictate moral behavior, ever!

Laws can only, ever, restrict and constrain those amenable to living a moral life.  A “Liberty FIRST Culture” understands this principle and protects itself accordingly.  Bringing this topic to a subject closely related to the “Rule of Law,” morals, morality, and moral living are all products of people amenable to religious belief structures.  Those people who desire to maintain connections to a religious society act their ideology through living a moral life.

Life ValuedI am not saying everyone needs to change religions; I am claiming that religion plays a significant role in reducing people’s animal minds to become amenable to living in a social order that respects the law and being ruled by law to enjoy maximum freedom.  We also need to be clear, atheism is a religion per Webster, and while this is a topic for another article, religion is a codified belief system with adherents that form a social order based upon expectations of behavior.  Liberty and freedom require choices; choices require more than a single option or two for a person to make more; Liberty and freedom require written and codified moral statements that grow from living a moral lifestyle.

NO MORE BS: Discretionary Funds – The Taxpayers Bain

Wasting TimeNew Mexico’s current Governor, Gov. Michelle Lujan Grisham (D), is being audited by the New Mexico State Senate for questions in how she uses the discretionary funds that come as a perk to her office.  While Gov. Grisham is not the first to abuse discretionary funds, nor will she be the last, abuse of discretionary funds in New Mexico is not the topic of this article.  Although, if I were a New Mexican Senator, I would hound the living life out of why the Governor thinks she can use those funds for her dry cleaning and then complain that from a budget of $7 Billion, “context is important.”

Scared Eyes!Context is not the issue in the use of discretionary funds, paid through forced taxation and other government means, to rob the citizen and businesses of their money.  Context, according to Webster is, “the circumstances that form the setting for an event, statement, or idea, and in terms of which it can be fully understood and assessed.”  Let us use Gov. Grisham’s spokesman Tripp Stelnicki’s own words for expounding upon the problem.  Please remember, Gov. Grisham is only being used as an example as she is currently in the news for dipping her hands into discretionary funds.  Many politicians need their discretionary funds scrutinized, audited, and accounted for by the politician to the public for wasting the public’s money.

Discretionary funds are an amount of money available to spend on things that are not considered necessary but may be useful.  How these funds are spent, how the funds are accounted, regulated, and controlled will vary from state to state, county to county, and city to city across America.  How discretionary funds are controlled and regulated across all democratically elected societies worldwide is extremely varied and complex.  The sole standard of discretionary funds is that they are a set amount of money budgeted, and the spending is considered “necessary” or “useful.”  Just do not forget, these funds come from the taxpaying public and should be publicly discussed, and accountability is required!

blue-money-burning-2New Mexico Governor (D) Bill Richardson’s annual spending of discretionary funds climbed to $139,000 in 2008 while playing host to Hollywood types foreign dignitaries and community groups the Governor wanted to woo.  The ethical lapses of discretionary spending were but one reason why Governor Susana Martinez (R) was elected as the people hoped for a change and better accountability for their tax dollars.  Sadly, Gov. Martinez was not the fiscal hawk needed. New Mexico State continues to struggle because of the politicians’ ethical and moral positions in the house, senate, and Governor’s mansion.  Not to mention the fiscal illiteracy found in the same politicians.

What are the dangers of discretionary funds?

Fraud appears to be the most obvious danger in discretionary funds.  A non-profit group in Flatbush helped rip off the discretionary funds’ scab and the scams that funnel millions of taxpayer dollars into politicians’ hands in a cycle of abuse of both non-profit organization’s discretionary funds.  Apparently, “a lack of control and oversight of the millions of dollars New York City appropriates annually to non-profit groups through council member earmarks, often referred to as pork-barrel spending.”

Government LargessPublic corruption also rears its ugly head where discretionary funds and people with hands out conduct business.  “Former City Representative Desiree Peterkin Bell, who ordered the $3 million deal in 2014, is charged by state prosecutors with theft and misuse of public money stemming from her oversight of the Mayor’s Fund, a non-profit used to promote Philadelphia and advance the mayor’s policy goals.  A state grand jury charged Bell in October 2019 with six felony counts related to public corruption for alleged theft and misuse of Mayor’s Fund dollars. Bell has denied all charges.”  Never forget, the politician controlling discretionary funds decides what is “useful” but not necessarily “needful” when spending discretionary funds.

Phantom Funding also appears as a hole through which discretionary funds come and discretionary funds go.  Consider New York City and the report from 2008 where “… the City Council had allocated funds to non-existent organizations, Council Speaker Christine Quinn declared that the council has “reformed” its decades-long practice of hoarding extra funding for pet projects.”  For New York City, the scandal for discretionary funds and phantom funds went as high as $20 Million annually.  Leading to a question for NM Gov. Grisham’s spokesman Tripp Stelnicki, “whose context should we keep in mind when discretionary funds are abused the politicians or the taxpayers stuck footing the bill?”

Pentagon BureaucracyWant some interesting insights on discretionary fund abuse; Courtney Gross raised some excellent points and identifies how the process works, just in New York City.  However, I have no doubt the same pattern is followed in abusing discretionary funds across America, maybe not in the exact dollar amounts, but definitely, a pattern followed.  Worse, Courtney Gross asked the questions all politicians who have discretionary funds available need to answer.

Discretionary funds are dangerous, as the Pope has discovered in 2020, where Mr. Tirabassi and Monsignor Perlasca, among a host of others known only by initials, set up schemes to raid the Vatican coffers of at least €454 Million in financial assets.  The investigation is ongoing in Italy and has taken a dramatic toll on the Catholic Church’s finances and reputation.  The scheme included blackmail, bribery, and a host of other financial crimes.  While those accused remain innocent until proven guilty, the fact that the Holy See is not impervious to discretionary fund abuse is a warning to everyone that discretionary funds are dangerous!

Detective 4A simple search of discretionary fund abuses brings up discretionary trading and a host of articles citing and supporting the claims that anything with the term discretionary in the title is an opportunity ripe for abuse by nefarious actors who want their cut.  Hence the problem, too many accounts in public funds include discretionary in their titles.  Like the famed hydra of old, if discretionary funds are removed, a new head will appear to abuse and steal the public’s money to the benefit of a few politicians, non-profit groups, and in the case in Rome, “consulting fees.”  The following suggestions support a “Liberty FIRST Culture:”

      1. All discretionary funds are ended forthwith, and if an account is needed, all receipts are open for public discussion, and details are paramount. Those spending the money need to provide the public the reason for the funds being spent.
      2. No unfunded liabilities are allowed, ever!
      3. Make it public with quarterly audits done by more than a single auditor and double-checked using a third and independent auditing system.  Fail an audit once, and the politicians are immediately removed, and a criminal investigation opens into financial crimes.
      4. Reduce the size of government! I cannot stress this point enough; size breeds problems, and theft is committed in the chaos!
      5. Personal accountability for how and why public funds are spent is missing in how politicians are currently conducting business. Begin to build into local and state laws methods and means for holding those abusing their position with the public’s money ways to hold them personally accountable legally.  Hence, if a politician misspends money, they are personally responsible for repaying those funds.  Suppose the Commanding Officer of a ship can be held accountable for marine life death due to shipboard operations. In that case, every single politician can be held responsible for the whales of public spending malfeasance they originate.

Leadership CartoonRemember, these suggestions are only a beginning to the solution, not the end resolution.  In conducting audits, previous politicians will be discovered for the schemes they perpetrated, and they will need to be held accountable.  Some schemes have lived for so long; the scheme is now an organizational design problem, costing money and other resources requiring locally adaptable solutions to correct.  Regardless, cleaning up the government’s size and the funds spent will be a significant undertaking requiring the best innovative minds.  Pitch IN!  We need all hands on deck to fix these problems and pay off the fiscal malfeasance!

NO MORE BS: Safety and Liberty – The Connection

DetectiveIn watching the United States Chemical Safety Board (USCSB/CSB) videos on YouTube, an epiphany occurred.  In a safety-first culture, the employees are all responsible for near-misses.  The employees are expected to have the ability to act in a manner conducive to and appropriate for the safe operations of their roles.  Next, each employee has the power to halt operations if a safety problem is detected or if a better solution presents itself to avoid near-misses and future incidents.  In the protection of the US Republic, every citizen has these same two powers for the continuation of liberty and freedom inside the borders of the United States of America.

Your political party is your choice.  I will never deny an individual to act as they believe in a free society.  Consider though the responsibility each citizen is under to protect this Republic by intentionally acting to avoid electing people who refuse liberty to others, deny freedom, or produce captivity for future generations through their actions.  Transcending the ambiguous division between political flavors, we remain citizens charged with protecting the Republic from harm and crimes committed by elected representatives.

Wasting TimeFor example, President Clinton had an extra-marital affair with Monica Lewinsky, this is a known fact, and this relationship has ruined Monica’s life and defined President Clinton’s presidency.  The affair damaged America’s core fabric, showing to the world the callousness of Hillary Clinton in the abuse of women who have come forward to accuse her husband of impropriety, and crimes against this country were committed, and justice was never delivered due to political gamesmanship.  Because politicians put politics before protecting this Republic, America has suffered tremendously, and other sex crimes and problems have further deteriorated America’s morals and culture.

Anthony Weiner is a sordid tale with direct connections to the Clinton Machine, more justice not served for the victims or the Republic, and the result has been nothing short of criminal.  Sexual impropriety by elected officials is the epitome of, and exemplification of, the definition of sexual harassment; but, too often, the politicians skate on responsibility, accountability, and even receive honors and glory; for more examples, see the Kennedy Family!

Detective 4Building a safety culture takes work, requires full engagement of every person, regardless of skin color, race, sex, handicap, etc., all must pull together to reduce safety incidents so that everyone can return to hearth and home at the end of the shift, with all appendages intact.  Yet, for some reason, the same philosophy is not applied to the Republic, which protects us.  The American Republic stands for law, truth, and moral accountability.  The Republic begs us to remember, honor, and unite under a single banner, the US Constitution.

While living in Seattle, I had a friend whose foot was crushed from the ankle into his safety toe by a forklift because the forklift operator ignored his ground guide’s commands.  Brutal incident caused tremendous pain and injury to the ground guide, my friend, and the operator lost his job for failure to comply.  Harsh penalties were issued all around.  The company lost, the labor union lost, my friend lost, the forklift operator lost, my friend’s family lost; but, when justice was done being served, mercy was extended as appropriate, compassion was felt, and the people involved possessed an opportunity to make changes and begin anew.  To recommit to safety, recommit to a new and better lifestyle and work style, and growth became possible.  Had justice not been as harsh as it was, healing could never have been possible, and frustration would have been the watchword.  Trust would be forever harmed, creating space for doubt, envy, malice, and other powerful negative emotions to thrive and endure.

PatriotismConsider Harvey Weinstein’s crimes, compare those to any politician caught in the same act, doing the same crime, for the same purposes, and ask yourself were they treated similarly under the law?  The answer you arrive at will dictate the culture you prefer.  Myself, I see the politicians being not held to a higher standard but a lesser standard and consider the US Constitution in trouble because of a “One rule for thee, but different for me” mentality.  Liberty is always jeopardized when one rule for all is not upheld.  Consider Rome, the Army had one rule, slaves a different law, politicians a separate rule, the Caesars had an entirely different rule, and their Republic failed because the “Rule of Law” was destroyed!

Just as a safety culture cannot be “for safety” and at the same time “not care about safety,” the US Constitution cannot be upheld and destroyed simultaneously.  Those for upholding the US Constitution, and the Republic of America, will act to exert justice upon those committing crimes and work for a “Rule of Law” just society. They know that under the “Rule of Law,” all are better off, regardless of political belief.  Those who would uphold a dual law system do so for personal power, political gain, and the ability to be enforcers of impropriety, also referred to as terrorists, tyrants, and troublemakers.

Politics is too often referred to as a “game.”  That axiom has a shelf-life and has passed the expiration date.  Politics should never be a “game,” for in degrading political leadership to game pieces, the people’s voice becomes lost, the tyrants, terrorists, and troublemakers gain power, and the US Constitution gets shredded in the process.  Worse, a real hazard is brought to the shores of this Republic.

The Duty of AmericansWe can do better!  We can be better!  We need to be better to save this Republic!  Thus, I implore the following:

        1. Cease allowing yourself to be separated over petty and insignificant divisions. Skin, race, sexual choices that do not infringe upon others’ rights and liberties, handicap, etc., do not matter.  In a “Liberty First Culture,” we accept all, and we expect all to shoulder the same burdens to the best of their abilities.
        2. “Liberty First Culture” requires an all-in mentality. Everyone is being asked to vote smarter, holding all political representatives to a higher moral, ethical, and legal standard as they represent us, not the lobbyists, not the tyrants, not the terrorists, and certainly not the troublemakers.
        3. A “Liberty First Culture” requires action! See something that threatens the liberty of all, say something, repeat as often as required to get attention, and then act accordingly.
        4. “Liberty First Culture” demands action in accordance with the law to change the law. We do not give up our liberties just because some hooligan has decided to step over the line to become a terrorist or troublemaker!  We, the lovers of liberty and freedom, know the law, follow the law, and demand redress for wrongs through the law.
        5. A “Liberty First Culture” insists upon unity first, understanding that more can always be accomplished through unified action than through singular action. Refuse the titles thrust upon people to divide and cause friction.  Unify under the banner of the US Constitution, and there is room for all here.

LinkedIn ImageA “Liberty First Culture” is needed right now in America and in every democratically elected society worldwide.  Liberty lovers far outnumber the petty thugs, wannabe tyrants, and terrorists, and it is past time for us to take the stand for liberty and freedom.  We can make a difference; believe that with your soul and blessed change will come!

A Failure to Listen – The Hinge Upon Which Governments Fail or Thrive

AmidalaPadmé in “Star Wars: Revenge of the Sith” makes a powerful statement about the galactic war being fought, “This war represents a failure to listen.”  While Padmé insists that diplomacy is required, this is incorrect.  Diplomacy is the political game of charades, with smoke and mirrors of intelligence games.  Diplomacy fails because each sides agenda is more important than the words being spoken, which is why so much of the work done in diplomatic circles is done in “informal settings.”  Diplomacy fails to listen.

America is a Republic, rather America is a Constitutional Republic, where the rule of law as written is the supreme law of the land to which every citizen is bond.  In the world there are democracies, where the mob rules.  There are socialist governments where the fat of government is forcibly taken through taxation and doled out by the micro-ounce to those selected to win or lose.  There are still communist governments and monarchies where the leaders are pampered to the detriment of the citizenry.  Unfortunately, between these extremes are a host of other government types who borrow pieces from many government theories thinking they can escape the negative consequences of those government methodologies.

Yet again we find Padmé’s counsel appropriate and timely.  Before war begins, there is always a refusal to listen.  For example, it is historically accurate that the US Government had signs and warnings of the impending Japanese Attack on Pearl Harbor, but the US Government had stopped listening to adverse advice, and America paid dearly for that failure to listen.  Worse, war came, and hundreds of thousands paid in blood for that failure to listen.

Emotional OutburstThe Russians thought diplomacy was the appropriate approach to Nazi Germany; and Nazi Germany made the Russians pay in blood for the failure of the government to listen.  Even though history has regularly taught the Russians not to engage in diplomatic solutions with Germans.  This was hardly the first fight between Germany and Russian troops and governments.  Failure to listen, and the citizens suffered tremendously to overthrow both Nazi Germany and then the chains of Communism.

Consider again the relationship between Mexico and the United States, the Mexican Government has never been an ally or friend to the United States; yet, the governments refuse to listen to common sense, and throughout history, those people hellbent on destroying America have always found safe passage and refuge in Mexican borders.  History relates that the failure of governments to listen, is the root of the United States and Mexican sour relationship.

Cuba has suffered under Communism and Castro’s poor ideas because government leaders refused to listen.  Venezuela fell because the governments in power refused to listen to each other, bribed the electorate, stole elections, and now a once mighty nation is starving while their government leaders sit in luxury.  How many times will this story have to repeat before the citizens of governments learn, we must be able to speak freely, and listen appreciatively, if we are to survive, grow, and prosper.

For too long, the powers of the world who consider themselves above the law have worked to keep the citizens separated into fighting factions.  Every conceivable line that can be drawn to distract, separate, denigrate, and deride has been drawn, and the only people winning in this are those drawing the lines.  Republicans against Democrats, Homosexuals against Heterosexuals, religions aplenty all against each other, state to state, NFL/NHL/NBA/NASCAR and so much more adding confusion and noise to the problem and further separating people along ambiguous lines to keep them from talking and listening appreciatively to each other.

Nuclear FamilyHow many families cannot have a meal without choices of lifestyle and hostility ending conversation over a failure to listen?  Can a Chicago Bears Family survive long with a fan from Minnesota or Wisconsin?  What about the other choices people make in their lives, religious flavor versus another religious flavor; this simple line has been destroying nations since history began being recorded.  What do we see in the Old Testament; governments repeatedly failing because they stopped listening.

Please note, this is not a call to drop standards, accepting everything, and singing “Kumbaya,” while Rome burns, and society dies an ignominious death.  This is a call to cease destroying society and begin listening first!  Why were the riots this past summer so brutal and destructive; first the mob stopped listening, then they stopped talking, and then they started fires and terrorizing society.  Why did they stop listening; because they assumed no one heard them and cared enough to shift the paradigm, (patterns of thought and action all based upon selfishness and pride).

Darth and AnakinWhy did Anakin stop being a Jedi; he stopped listening, then he selectively listened, he began acting as a terrorist, and then he became Darth Vader.  This plot line of refusing to listen is so prevalent and obvious because humans continue to make the same mistake.  When we stop listening to each other, we stop talking; when we stop talking, we become overwhelmed by our own echo-chambers, and create the chaos that ultimately destroys our lives, our dreams, and our futures until we begin to lay aside petty differences and listen to each other again.

Listening has four distinct levels:

    • Inactive listening – Hearing words, seeing written communication, zero impact mentally. Mostly because your internal voices drown out the possibility for communication.
    • Selective listening – Hearing only that which confirms your own voices, opinions, and biases. While others are speaking, you are already forming your response.
    • Active listening – Show the other person you are paying attention, engage with meaning in a reply. Focused upon removing barriers to get your point across.
    • Reflective listening – Paying attention to intent and content, reducing emotion, two-direction as both parties are engaged in achieving mutual understanding.

Social Justice WarriorListening appreciatively is reflective listening, where we commit to listening with the intent to achieve mutual understanding.  Essentially, to improve government we must listen first with the intent to reach mutual understanding, before we ever open our mouths to speak.

The following are some launch points for improving listening in society:

      1. Understand your desire.  Know that your desire choices are determining your destiny.  If your destiny is not one you appreciate, return to desire, make different choices.
      2. Practice mental preparation based upon previous situations, to make different choices.  Listening is a voyage of discovery to reach a mutual understanding, but mental preparation is key to safely reach the destination.  Prepare, use a mirror, practice until what currently feels alien becomes familiar.
      3. Reduce emotion.  The principle of empathy and sympathy are destroying listening and only reflect the internal voices.  The volume of internal voices is silencing the ability to reflectively listen, necessitating the need to fake actively listening.
      4. Listen as you would have others listen to you.  This is an adaptation of the “Golden Rule” and remains applicable as a personal choice.  How you choose to listen will determine your destiny.
      5. Listening remains the number one tool you control and has application to written communication and verbal communication channels.  Body language is a non-verbal communication channel that can be heard as well as seen.  How are you communicating non-verbally which is interfering with your written and verbal communication attempts?

Leadership CartoonListening is a choice.  Listening is hard.  Yet, many people have pointed out that we have two ears and one mouth so we can listen twice as often as we speak.  Choose to reflectively listen, choose to reach a mutual understanding, watch society change.  It has been said that the US Constitution will hang by a thread, rule of law and the American Republic hang upon our decisions to listen appreciatively to each other and to stop allowing petty divisions to destroy ourselves, our families, and our American society.
